The leading statement of the Iran responsibility thesis

[Five years ago today OhmyNews International published a long article by Dr Ludwig de Braeckeleer headed Former Iranian President Blames Tehran for Lockerbie. The following is merely a short excerpt:]

In an interview conducted on May 16 [2008], Abolhassan Bani-Sadr, the former president of the Islamic Republic of Iran, told me that Tehran, not Libya, had ordered the bombing of Pan Am 103 in revenge for the downing of an Iranian civilian airliner by the USS Vincennes a few months earlier.

On July 3, 1988, the navy cruiser USS Vincennes, also known as "Robocruiser," shot down Iran Air Flight 665 over the Persian Gulf. The civilian airliner was carrying mostly Muslims on their pilgrimage to Mecca -- 290 died, most Iranians.

According to Bani-Sadr, in the immediate aftermath of the Lockerbie tragedy, [Ali Akbar] Mohtashemi-Pur, the then minister of the interior, acknowledged in an interview that he had contracted Ahmad Jibril, the leader of a Palestinian organization, to bomb an American airliner. The interview was scheduled for publication the following day. Hours before distribution, the newspaper was shutdown.

In the aftermath of the USS Vincennes accident, top figures in the Iranian government held a series of meetings in Beirut with leaders of Ahmed Jibril's terror group, the PFLP-GC (Popular Front for the Liberation of Palestine-General Command).

"Everybody in US intelligence knew about Iran's intention to bomb an American airliner in response to the downing of one of its own only months earlier. We knew that," former CIA operative Robert Baer explains.

"There was a smoking gun in July '88 that Iran hired Jibril to knock down at least one American plane," Baer told me. And indeed, media have long reported that high-ranking Iranian officials held a meeting with [Hafez] Dalkamoni, a trusted lieutenant of Jibril and a man said to be only known by the CIA as Nabil. In late October '88, Dalkamoni and Ghadanfar, alias Nabil Massoud, were arrested in Frankfurt where they were running an operation to destroy airliners.

"I was assigned to Paris in 1988 running down leads with French police on both Pan Am 103 and UTA [Union des Transports Aeriens] -- I do not know the ultimate judgment on the leads we produced. Or why precisely the case is being reviewed by Scotland. Keep in mind in your research that intelligence and evidence are two separate domains. Often it's the case [that] compartmented intelligence is not shared with the FBI. I do not know what the FBI was given or not given," Baer added.

"There's a world of intercepts and information from sources that is never shared with the FBI. This is because the controller of the information doesn't want to compromise the source. At the CIA, we look at the FBI as trying to get convictions, while intelligence is to get at a proximate truth."

Reacting to the downing of Airbus 665, Ali Akbar Mohtashemi-Pur swore that there should be a "rain of blood" in revenge. Mohtashemi had been the Iranian ambassador in Damascus from 1982 to 1985. He is widely believed to have helped to found Hezbollah in Lebanon and had close connections with the terrorist groups of Beirut and the Bekaa Valley.

The National Security Agency intercepted and decoded a communication of Mohtashemi linking Iran to the bombing of Pan Am 103. One intelligence summary, prepared by the US Air Force Intelligence Agency, was requested by lawyers for the bankrupt Pan American Airlines through the Freedom of Information Act.

A classified document prepared for the Multi-National Force during the first Gulf War reads: "Mohtashemi is closely connected with the Al Abas and Abu Nidal terrorist groups. He is actually a long-time friend of Abu Nidal. He has recently paid $10 million in cash and gold to these two organizations to carry out terrorist activities and was the one who paid the same amount to bomb Pan Am Flight 103 in retaliation for the US shoot-down of the Iranian Airbus."

Caveat: Former FBI Special Agent Richard Marquise led the Lockerbie investigation. Marquise has told me that the document came from a source of unknown reliability. However, careful reading shows that the source makes a clear difference between rumours and facts.

While parts of the document reads: "Mohtashemi is said to [have done this or that]," the paragraph regarding Pan Am 103 is factual. It reads: "He has recently paid…"

The difference of style cannot be ignored.

The grim Lockerbie shadow over Iran’s new president

[This is the headline over an article by David Wolchover published yesterday evening on the Jewish News website.  It reads as follows:]

Addressing the United Nations General Assembly this month, Benjamin Netanyahu memorably described Hassan Rouhani, the recently elected president of Iran, as “a wolf in sheep’s clothing”, cautioning that we should not be taken in by his “charm offensive” on the West.

Is this any more than bombastic alarmism, cried out in desperation by a worried man in charge of an increasingly-beleaguered Israel or is there substance in the warning? Analysis of Rouhani’s biography will provide a clear answer and it is chilling. His ostensible career as a serious-minded and seemingly decent person begins promisingly enough.

Educated at the prestigious Qom seminary with a clerical career beckoning, he went on to obtain his doctorate in Constitutional Law from Glasgow Caledonian University in 1999 with a thesis worthily entitled “The Flexibility of Shariah (Islamic Law) with reference to the Iranian experience”. Yet Rouhani’s distinguished scholastic attainment contrasts with a rather less happy connection with Scotland a decade earlier.

On 3 July 1988 a jumpy radar analyst on board the US Navy’s Gulf-based missile cruiser Vincennes identified an approaching aircraft as an Iranian F-14 Tomcat. Two missiles were launched but the target proved to be an Airbus, IranAir Flight 655, making the short hop from Bandar Abbas to Dubai with 290 passengers and crew.

Instead of eating humble pie, the Reagan administration ineptly tried to justify the tragedy as the consequence of a legitimate measure of self-defence and rubbed salt in the wound by awarding the hapless “air warfare co-ordinator” a navy medal for “heroic achievement”. Absurdly, the Iranian government claimed the destruction of Flight 655 was intended to celebrate the Fourth of July and with its traditional penchant for “symmetry” determined on revenge in like measure.

Following his 1986 showdown with the Regan government, Libya’s Colonel Gaddafi made a show of “going straight”, including cutting off funds from the Popular Front for the Liberation of Palestine: General Command, whose founder, Ahmed Jibril, was forced to seek fresh sources of revenue. To Jibril, the Airbus incident seemed like manna from heaven and with its network of informants on the ground Israeli intelligence soon learnt he was serenading the Iranians with an offer to execute a contract of revenge. Using their combined technical resources, Mossad and the CIA obtained clear evidence of a deal between Jibril and Iran’s powerful hard-line interior minister, Hojatolislam Ali Akbar Mohtashemi-Pur, by which Iran agreed to pay the PFLP-GC a bounty running into millions of dollars if it managed to destroy a packed American airliner.

The upshot was the destruction over Lockerbie on 21 December 1988 of Pan American Flight 103, with the loss of only 20 souls fewer than went down with the Airbus. The US chose to accuse Libya instead of the PFLP-GC, but even a cursory reading of the evidence against the only man to be convicted of the bombing, Abdelbaset al-Megrahi, shows the case against him, and by extension Gaddafi, was tosh. This article is not about retrying Megrahi, dead now for 18 months.

President Rouhani is the subject. But what has he to do with Lockerbie? For those who know their history of Iranian revolutionary power-politics, the answer is not difficult to infer.

We need to look at his connection with Mohtashemi, the Lockerbie deal-maker. As ambassador to Syria, Mohtashemi had a key role in the creation of Hezbollah in the Lebanon and although appointed interior minister in 1995 continued an active association with Syrian military intelligence in the Lebanon.

In that capacity, he was the natural choice to talk to Jibril and in agreeing to pay out millions of dollars for an act of war against the US we can be certain he was hardly engaging “on a frolic of his own,” as lawyers might put it. As a mainstream politician it is inconceivable that he was not plenipotentiary for his government and the Ayatollah Khomeini. The Supreme Leader had been quite prepared to sacrifice hundreds of thousands as cannon fodder in the Iran-Iraq war, demonstrating no aversion to the shedding of innocent blood, especially of citizens of the “great Satan,” the USA.

So to the supposedly-moderate figure of Mohammad Hashemi Rafsanjani, later to become president of the Republic. In June 1988, backed by Khomeini, who had at last seen the light, Rafsanjani was working on ending hostilities with Iraq. His star was in the ascendant but Mohtashemi saw the downing of the Airbus as a perfect opportunity to strike at Rafsanjani and discredit the rising influence of the moderates. Rouhani, born in 1948, was a contemporary of Mohtashemi’s, born in 1947, and had already been marked for high office, elected to the Majlis, the parliament, as early as 1980, and, importantly, a member of the Supreme Defence Council in the crucial period from 1982 to 1988. He held top military positions during the Iran-Iraq war, and was heavily involved in the Iran-Contra episode.

He held diverse positions of executive authority over Iran’s intelligence, security and clandestine operations establishment for a number of years straddling the fateful year 1988 and was plainly a significant player. As such it is inconceivable that he could have had no knowledge of the deal with Jibril.

Of course, exercising all due forensic restraint, it can be argued that knowledge of a plan is no proof of complicity in its execution or of having aided and abetted the instrumental perpetrators. Yet knowledge of the existence of a secret conspiracy is usually regarded as the best evidence of participation. The deal with Jibril can only have been authorised on the highest authority.

Rouhani was a high official in intelligence and security. He was a close ally of Mohtashemi in their opposition to Rasfanjani. Can he conceivably have played no role with others in formulating the terms of the contract and authorising his intimate associate to close the deal? Metaphorically speaking, the fingerprints of President Rouhani are all over the bomb that shattered Flight 103 over Lockerbie.

Iran, not Libya, said US Defense Intelligence Agency

[What follows is excerpted from an item posted on this blog on 23 August 2009:]

It took the use of the US Freedom of Information Act to unlock the full intelligence documents which are now highlighted in the appeal submission. [RB: This refers to the appeal abandoned by Megrahi prior to his compassionate release.]

They show memos from the US Defense Intelligence Agency (DIA) which suggested the downing of Pan Am Flight 103, which killed 270 people in 1988, was in response to the shooting down of an Iranian Airbus by the American warship USS Vincennes five months earlier.

In a memo dated September 24, 1989, and reproduced in the appeal submission, the DIA states: ‘The bombing of the Pan Am flight was conceived, authorised and financed by Ali-Akbar Mohtashemi-Pur, Iran’s former interior minister.

‘The execution of the operation was contracted to Ahmad [Jibril], Popular Front for the Liberation of Palestine General Command [PFLP-GC] leader, for a sum of $1million [£600,000].

‘$100,000 of this money was given to Jibril up front in Damascus by the Iranian ambassador to Sy [Syria], Muhammed Hussan [Akhari] for initial expenses.

'The remainder of the money was to be paid after successful completion of the mission.’ (...)

The memos and reports, denied in full to the original trial, were available to the Scottish Criminal Cases Review Commission which, two years ago, cast doubt on the safety of Megrahi’s conviction based on six separate counts of the legal argument.

Their view opened the way for a second appeal.

[What follows is an excerpt from Dr Davina Miller’s article Who Knows About This? Western Policy Towards Iran: The Lockerbie Case:]

On 24 September 1989, the US Defence Intelligence Agency (DIA), in a secret information report not releasable to foreign nationals and relying on information acquired through the National Security Agency (NSA) at Fort Meade (ie through Foreign Signals Intelligence), asserted that the attack on Pan Am Flight 103, “was conceived, authorised and financed by Ali-Akbar (Mohtashemi-Pur)”, the former Iranian Minister of the Interior. The execution of the operation was contracted to Ahmad (Jabri’il), the PFLP-GC leader, for the sum of $1,000,000. The report was highly detailed in describing the organisation of the bombing and claimed that, “the flight was supposed to be a direct flight from Frankfurt to New York, not Pan Am Flight 103”.[xxxii][32]

In October 1989, a further DIA report noted that Iranian “radicals want to be able to retaliate in less time than it took them to carry out the Pan Am 103 bombing”.[xxxiii][33] The CIA’s ‘Terrorism Review’ for 14 December 1989 also noted that liaison between Iran and radical Palestinian groups “was most likely responsible for the bombing of Pan Am 103”.[xxxiv][34]

The Defence Intelligence Agency in a brief in December 1989, titled “Pan Am 103: Deadly Co-operation” argued that, “Iran probably was the state sponsor for the PFLP-GC attack on Pan Am 103”. The same report noted:  that the bomb was “a sophisticated, barometrically triggered explosive device probably fabricated by the PFLP-GC”; that “DIA believes the device was placed aboard...in Frankfurt”; and that, “analysis of material confiscated from this PFLP-GC cell has provided strong circumstantial evidence linking the cell to the bombing”. The report further detailed the relationship between Iran and the PFLP-GC, including the initial overtures, payment for Pan Am 103, and the latter’s exploitation of Iran’s “established terror network in Europe”.[xxxv][35]

More from Dr De Braeckeleer

In his most recent article in OhMyNews International (the latest in a multi-part series on the background to the Lockerbie disaster) Dr Ludwig de Braeckeleer has this to say:

'Just days after the downing [of Pan Am 103], the Iranian charge d'affaires in Beirut, Hussain Niknam, invited [Ahmed] Jibril at the Iranian Embassy. A few days later, several meetings occurred in Tehran. Among the participants, one finds Mohtashemi-Pur, Jibril and several representatives of the Iranian Revolutionary Guards and Hezbollah.

'According to the minutes of one of these meetings obtained by a German magazine, [Quick] Iran ordered the destruction of Pan Am Flight 103 to avenge the shooting down of an Iranian civilian jet by the US Navy in the Persian Gulf. Tehran paid Ahmed Jibril about $1 million in advance to carry out the attack.

'"We had advanced notice. The smoking gun came in July," Former CIA case officer Bob Baer told me earlier this month.

'"We had info that Iranian representatives of the Islamic Revolution Guards have signed an agreement with a Palestinian group to bring down a plane. The investigation data was superb. It couldn't have been better," Baer has said previously.

'Patrick Lang, chief of the US Defense Intelligence Agency's Middle East section at the time, told me that he stands by his statement that "the bombing of the Pan Am flight was conceived, authorized and financed by Ali-Akbar Mohtashemi-Pur, the former Iranian minister of interior."

'According to a DIA memo, "the operation was contracted to Ahmad Jibril for $1 million." The remainder was to be paid after successful completion of the mission. (Jibril's organization did receive $10 million on Dec. 23, two days after the bombing of Pan Am 103.)

'Various media have quoted Lang as saying: "I still agree with that. We felt quite sure that this was a PFLP thing." In a recent e-mail, Lang told me that he meant the PFLP-GC -- that is, the group led by Ahmed Jibril. The PFLP is another group.'

Blame Iran, not Libya, for Pan Am Flight 103 bombing

[This is the headline over an article by Arthur F Bethea published today on the website of the Massachusetts newspaper South Coast Today. It reads as follows:]

In a late June press conference, President Obama said that Col Gadhafi, "prior to Osama bin Laden, was responsible for more American deaths than just about anybody on the planet."

Ignoring George Bush's needless invasion of Iraq that led to the deaths of more than 4,400 US soldiers, Obama linked Gadhafi and bin Laden to deceive less-informed viewers into thinking that the two are one and the same. They aren't. In 1998, Libya issued the first official Interpol arrest warrant against bin Laden, and Gadhafi condemned 9/11. An enemy of bin Laden, Gadhafi opposes radical Islamic fundamentalism.

Obama was also alluding to the 1988 bombing of Pan Am Flight 103 over Lockerbie, Scotland, that murdered 189 Americans. This indirect smearing is reminiscent of Bush, who implied falsely (but never directly asserted) that Saddam sponsored 9/11. If Obama wants to accuse Gadhafi of Lockerbie, he should man up and state the charge directly.

Many people assume that Gadhafi is guilty of the Lockerbie bombing because a Libyan intelligence officer (Abdelbaset Ali Mohmed Al Megrahi) was eventually convicted. What few Americans know is that the trial's fairness has been convincingly disputed. Key witnesses appear to have been paid for their testimony, evidence may have been fabricated, one crucial witness has admitted to perjury, and the witness who identified Megrahi has had his reliability attacked by the prosecutor who brought the original charges.

A former professor of Scottish law at Edinburgh University, Robert Black, said, "No reasonable tribunal, on the evidence heard at the original trial, should or could have convicted" Megrahi. The conviction was "an absolute disgrace and outrage." Megrahi is "an innocent man."

Some readers will protest, "But Gadhafi paid damages; he must be guilty." Yes, Libya paid more than $2.5 billion in reparations, but, according to one source, sanctions had cost the country $30 billion. Saif al-Islam, Gadhafi's son and former heir apparent, explained, "We wrote a letter to the Security Council saying we are responsible for the acts of our employees," but this "doesn't mean that we did it in fact." "What can you do?" he asked. "Without writing that letter we would not be able to get rid of sanctions."

Compelling evidence implicates Iran in the Lockerbie bombing. Thinking it was about to be attacked by a fighter jet, the USS Vincennes shot down an Iranian airbus in July 1988, killing 290 people, most of them Iranians. Iran's religious dictator, the Ayatollah Khomeini, promised that the skies would rain with American blood. Iran offered a huge reward for revenge; a Palestinian terrorist organization, the Popular Front for the Liberation of Palestine General Command, apparently accepted the offer; and 5½ months after the Vincennes disaster, 189 Americans were murdered.

A senior CIA officer in 1988, Robert Baer, worked the case from the start and concluded that Iran sponsored the bombing. According to Baer, now retired from the CIA, financial records indicate that Iran transferred $11 million to the Swiss bank account of the PFLP-GC two days after the bombing. Obviously, if Iran did transfer $11 million to a Palestinian terrorist group two days after the atrocity, this is overwhelming evidence of Iranian involvement. England's Sunday Herald said it saw the "CIA paperwork that supports" Baer's claims.

In 2009, Baer told England's Sunday Mail that the CIA had "hard evidence" of Iranian involvement "almost from the moment the plane exploded."

Another American intelligence organization also linked the bombing to Iran. A September 1989 memo from the Defense Intelligence Agency states: "The bombing of the Pan Am flight was conceived, authorized and financed by Ali-Akbar Mohtashemi-Pur, Iran's former interior minister."

There are many good reasons to oppose Obama's Libyan adventure but no good ones [to support it], including false revenge for Lockerbie.

$2m witness payment, bogus forensic evidence and Pentagon memo blaming Iran: How Lockerbie bomber appeal threatened Scottish justice

[This is the headline over a long and highly detailed article in the Mail on Sunday. The following are excerpts:]

In a submission to the Court of Appeal running to thousands of words, Megrahi’s lawyers list 20 grounds of appeal which include:

* Details of a catalogue of deliberately undisclosed evidence at the original trial.
* Allegations of ‘tampering’ with evidence.
* A summary of how American intelligence agencies were convinced that Iran, not Libya, was involved but that their reports were not open to the 2001 trial.

[Note by RB: I strongly suspect that what is being referred to is the submission made on Mr Megrahi's behalf in 2003 to the Scottish Criminal Cases Review Commission, not the Grounds of Appeal lodged with the Criminal Appeal Court once the SCCRC had referred the case back.]

The closely guarded submission was obtained by Ian Ferguson, an investigative journalist and co-author of the book Cover-up of Convenience - The Hidden Scandal of Lockerbie.

But the evidence will never be tested in open court after the dying Libyan abandoned it last week to spend his final days with his family.

Mr Ferguson, who has had 100 hours of unprecedented access to the 57-year-old former Libyan intelligence agent during his eight years in jail, claimed last night: ‘From the start there was a determination to try to prevent this appeal being heard.

'It opened but never got off the ground, with stall after stall as each month Megrahi weakened with the cancer that was killing him.

‘There was rejoicing in the Crown Office in Edinburgh when he was released and the appeal abandoned.

'There may well be political manoeuvres behind his release but at the heart was a decision to save the face of the Scottish judiciary - in particular the Crown Prosecution, who would have been shown to have been involved in an abuse of process by non-disclosure of witness statements.’

Mr Ferguson said: ‘Megrahi was made the scapegoat for whatever reason and from that point everything went in reverse to try to make the crime fit.’

Central to Megrahi’s conviction was the evidence of Maltese shopkeeper Tony Gauci, who claimed that Megrahi had bought clothes allegedly found in the suitcase bomb.

Lawyers were due to claim that Gauci was paid a $2million reward for his evidence, which followed more than 20 police interviews, and that many of the often wildly conflicting statements taken on each occasion were withheld from the defence.

Mr Ferguson says that, although too late for the submission, lawyers were planning to spring a witness called David Wright, an English builder who was on holiday in Malta and who is said to have information about the clothes shop.

He would have produced evidence as to the date and buyer of the clothes, seriously undermining Gauci’s reliability and credibility.

It is now believed that Gauci has moved to Australia.

Other new evidence listed in the grounds for appeal would have called in new witnesses to prove that the fragment of circuit board from a timing device found near the crash and pointing to Libyan involvement simply could not have survived such an explosion.

Subsequent analysis carried out by an independent forensic scientist found no trace of explosive on the tiny piece. (...)

Also due to be called was a witness who would allegedly discredit the accepted account that the suitcase in which the bomb was placed had somehow travelled unchecked and unaccompanied from Malta to Frankfurt and on to the Pan Am flight.

Questions would have been asked as to how a fragment of cloth - believed to be from the clothing wrapped around the bomb - subsequently came to be packed with material linking it direct to the bomb.

Mr Ferguson added: ‘Had this appeal gone ahead and witnesses recalled and cross-examined, I believe it would be shown that some had most definitely perjured themselves or deliberately misled the court.

‘It is no wonder that some people were hoping Megrahi would die before certain witnesses were called.

'The release on compassionate grounds is a blessed release for them, as much as it was for him.’

Mr Ferguson, who now lives in France but continues to pursue ‘leads’ in the case, first met Megrahi in 2002 and says he was a constant visitor over the years as they went over every aspect of the evidence against him.

‘From the start I was struck by his total, unchanging, quiet protestation of his innocence.

'He readily admitted that his job was sanction-busting for the Libyan government but never anything more sinister.

‘He frequently said he knew his government were involved in many things but always looked me straight in the eye and said: "I am not a killer".

Despite seeing the by then frail and faltering Megrahi only four weeks ago as he waited to hear if he could be sent home, Mr Ferguson insists he did not press him on any political dealings which may have been going on behind the scenes.

He added: ‘Politics may have got him into prison but I believed it was only evidence that could get him out.

'I never believed, though, that he would give up the appeal after so many years of fighting for it. That was all we focused on in our meetings - his refusal to give up.

'At the end, though, I agreed with his decision because, otherwise, he would not have been able to get what he most wanted - to live out his last days with his family.’

Megrahi was diagnosed with terminal cancer in September last year.

Mr Ferguson, who saw him two months later, said: ‘He already looked very different. His complexion was drawn and he’d lost a lot of weight.

'He cried as he told me how he had been called into the prison governor’s office and learnt his cancer was inoperable and ultimately untreatable.

‘He called his wife and they were both crying for 15 minutes. He wasn’t embarrassed to cry in front of me.

'I’d had cancer myself in 2002, so I knew what he was going through.

'I contacted a psychologist specialising in this disease who I hoped would help him deal with it.’

Since Megrahi’s diagnosis, Mr Ferguson has seen him four times.

He added: ‘Our visits were shortened because he couldn’t sit down for too long before being in pain.

'Because he is so religious he wasn’t scared of death but he was desperate to have his name cleared before he died.

‘I felt he was being blackmailed but he never admitted it.

'The Crown wouldn’t agree to transfer him unless he gave up his appeal and the longer they stalled the more fragile he became physically. In the end he just couldn’t continue.’

He first met Megrahi and his lawyer in Glasgow’s Barlinnie prison - and quickly became convinced that he was innocent.

He said: ‘The first thing I asked him was if he had had anything to do with the bombing.

'He insisted he hadn’t and was convinced from the start his conviction would be overturned. He seemed smart and intelligent without being arrogant and very angry.

'The evidence was purely circumstantial and came at a time when the West wanted to implicate Libya at a time when it was politically inconvenient to accuse the real culprits.’

Over the months the pair reached a tacit understanding: ‘It was never spoken outright but Megrahi knew I would never jeopardise his trust by writing about our meetings.’

Finger of blame for Lockerbie pointed at American citizen

In a sensational twist, Abu Elias, currently living near Washington DC, will be named with others believed to be in the Popular Front for the Liberation of Palestine - General Command (PFLP-GC) as part of a terror cell behind the Pan Am disaster.

Lawyers claim the radical Palestinian organisation was hired for $10million to avenge the shooting down of an Iranian airliner by the US five months earlier.

Two weeks ago Libyan Abdelbaset Ali Mohmed al-Megrahi, 55, was given the right to appeal his conviction.  Elias - who has a new identity the Sunday Express cannot divulge - is the nephew of the terror group's leader, Ahmed Jibril, the man believed to be the mastermind of the bombing.

The Sunday Express understands new documents - likely to form the basis for al-Megrahi's appeal - show the American was described as "the primary target" early in the investigation.  They also state he conspired with Mohammed Abu Talb, an Egyptian named by Dumfries and Galloway Police as the initial chief suspect.

Lockerbie relatives last night said they are more convinced than ever that the PFLP-GC are the perpetrators of the atrocity. Dr Jim Swire, who lost daughter Flora in the disaster, said: "My view has always been that Abu Talb was involved but that he was not the actual bomber. This development is encouraging and opens new avenues."

Pan Am Flight 103 was just 38 minutes into its journey from London to New York when it was blown up.  Investigators concluded a Semtex bomb was in a cassette player rigged with a Swiss electronic timing device.  Al-Megrahi was convicted in 2002 following a £75million trial at a Scottish Court, at Camp Zeist in the Netherlands, although his co-accused Al-Amin Khalifa Fahima was cleared.

But the Scottish Criminal Cases Review Commission (SCCRC) has identified six grounds where it believes a miscarriage of justice may have occurred, with its main focus on the evidence from Tony Gauci, who said  al-Megrahi had come into his shop in Malta and bought clothes found at the scene of the disaster.

With the decision, the finger of blame is once again being pointed at the PFLP-GC. Jibril was suspected of organising the bombing on behalf of Iran as revenge on the US for shooting down Iran Air 655 over the Persian Gulf in 1988.

Evidence submitted to the SCCRC named Jibril, now 79, as the mastermind, with his nephew working with Abu Talb, a member of a splinter group and later jailed for life in Sweden for a bomb attack that left one person dead.

The defence case included a US Defence Intelligence Agency cable from September 24, 1989, which states: "The bombing of the Pan Am flight was conceived, authorised and financed by Ali-Akbar (Mohtashemi-Pur), the former Iranian Minister of Interior.

"The operation was contracted to Ahmad Jabril (sic)... for $1million. The remainder was to be paid after successful completion of the mission."

Documents viewed by the Sunday Express allege the plot began when a man named Mobdi Goben supplied material for the bomb to Hafez Dalkamoni, the leader of the PFLP-GC's European cell. He was then introduced to the alleged bomb maker Marwan Khreesat, by Elias, who has both Syrian and American passports.

Very little is known about Elias, but the defence insists he was paid in travellers' cheques by terror leader Dalkamoni in Cyprus, before he took delivery of the bomb in Frankfurt.  Elias was identified as the key suspect although it was never explored in court, even after documents about his role suddenly emerged during the trial.

The Goben Memorandum, said to have been written by a dying member of the PFLP-GC, was handed to the Lord Advocate detailing the group's activities and a confession about Elias. Elias was concerning the FBI before the bombing and was quizzed about cheques deposited in his bank. In August 1988 he met with agents, who knew he was Jibril's nephew. While the SCCRC said there is dubiety over whether Gauci had correctly identified al-Megrahi, documents show the shopkeeper had no such problems identifying Abu Talb.

Despite the evidence, the investigation took an unexpected twist and the Syrian terror group's suspected role in the disaster was dropped. Meanwhile, it emerged Talb could be brought to trial in Scotland because he does not have lifetime immunity from prosecution as had been believed. During al-Megrahi's trial there was a widespread belief he had been given Crown protection for giving evidence. However, the Crown Office yesterday confirmed he does not have immunity.

Operation Autumn Leaves

[On this date in 1988 the German police arrested seventeen men at Neuss in operation “Autumn Leaves” (Herbstlaub). What follows is excerpted (with citations removed) from the relevant article in Wikipedia:]

For many months after the bombing, the prime suspects were the Popular Front for the Liberation of Palestine—General Command (PFLP-GC), a Damascus-based rejectionist group led by former Syrian army captain Ahmed Jibril, sponsored by Iran. In a February 1986 press conference, Jibril warned: "There will be no safety for any traveler on an Israeli or U.S. airliner" (Cox and Foster 1991, p28).

Secret intercepts were reported by author, David Yallop, to have recorded the Iranian Revolutionary Guards (Pasdaran) in Baalbeck, Lebanon, making contact with the PFLP-GC immediately after the downing of the Iran Air Airbus. Israeli intelligence (Mossad) allegedly intercepted a telephone call made two days after PA 103 by Mohtashemi-Pur, Interior Minister in Tehran, to the chargé d'affaires at the Iranian embassy in Beirut, instructing the embassy to hand over the funds to Jibril and congratulating them on the success of "Operation Intekam" ('equal and just revenge'). Jibril's right-hand man, Hafez Dalkamoni, set up a PFLP-GC cell which was active in the Frankfurt and Neuss areas of West Germany in October 1988, two months before PA 103. During what Germany's internal security service, the Bundesamt für Verfassungsschutz (BfV), called Operation Herbstlaub ('Operation Autumn Leaves'), the BfV kept cell members under strict surveillance. The plotters prepared a number of improvised explosive devices (IEDs) hidden inside household electronic equipment. They discussed a planned operation in coded calls to Cyprus and Damascus: oranges and apples stood for 'detonating devices'; medicine and pasta for 'Semtex explosive'; and auntie for 'the bomb carrier'. One operative had been recorded as saying: "auntie should get off, but should leave the suitcase on the bus" (Duffy and Emerson 1990). The PFLP-GC cell had an experienced bomb-maker, Jordanian Marwan Khreesat, to assist them. Khreesat made at least one IED inside a single-speaker Toshiba Bombeat 453 radio cassette recorder, similar to the twin-speaker model RT-SF 16 Bombeat that was used to blow up PA 103. However, unlike the Lockerbie bomb with its sophisticated timer, Khreesat's IEDs contained a barometric pressure device that triggers a simple timer with a range of up to 45 minutes before detonation.

Unbeknown to the PFLP-GC cell, its bomb-maker Khreesat was a Jordanian intelligence service (GID) agent and reported on the cell's activities to the GID, who relayed the information to Western intelligence and to the BfV. The Jordanians encouraged Khreesat to make the bombs but instructed him to ensure they were ineffective and would not explode. (A German police technician would however be killed, in April 1989, when trying to disarm one of Khreesat's IEDs). Through Khreesat and the GID, the Germans learned that the cell was surveying a number of targets, including Iberia Flight 888 from Madrid to Tel Aviv via Barcelona, chosen because the bomb-courier could disembark without baggage at Barcelona, leaving the barometric trigger to activate the IED on the next leg of the journey. The date chosen, Khreesat reportedly told his handlers, was October 30, 1988. He also told them that two members of the cell had been to Frankfurt airport to pick up Pan Am timetables.

Acting upon this intelligence, the German secret police moved in to arrest the PFLP-GC cell on October 26, raiding 14 apartments and arresting 17 men, fearing that to keep them under surveillance much longer was to risk losing control of the situation. Two cell members are known to have escaped arrest, including Abu Elias, a resident of Sweden who, according to Prime Time Live (ABC News November 1989), was an expert in bombs sent to Germany to check on Khreesat's devices because of suspicions raised by Ahmed Jibril. Four IEDs were recovered, but Khreesat stated later that a fifth device had been taken away by Dalkamoni before the raid, and was never recovered. The link to PA 103 was further strengthened when Khreesat told investigators that, before joining the cell in Germany, he had bought five Toshiba Bombeat cassette radios from a smugglers' village in Syria close to the border with Lebanon, and made practice IEDs out of them in Jibril's training camp 20 km (12 mi) away. The bombs were inspected by Abu Elias, who declared them to be good work. What became of these devices is not known.

Some journalists such as Private Eye's Paul Foot and a PA 103 relative, Dr Jim Swire, believed that it was too stark a coincidence for a Toshiba cassette radio IED to have downed PA 103 just eight weeks after the arrest of the PFLP-GC cell in Frankfurt. Indeed, Scottish police actually wrote up an arrest warrant for Marwan Khreesat in the spring of 1989, but were persuaded by the FBI not to issue it because of his value as an intelligence source. In the following spring, King Hussein of Jordan arranged for Khreesat to be interviewed by FBI agent, Edward Marshman, and the former head of the FBI's forensic lab, Thomas Thurman, to whom he described in detail the bombs he had built. In the 1994 documentary film Maltese Double Cross, the author David Yallop speculated that Libyan agents and agents paid by Iran may have worked on the bombing together; or, that one group handed the job over to a second group upon the arrest of the PFLP-GC cell members. The former CIA head of counter-terrorism, Vincent Cannistraro, who previously worked on the PA 103 investigation, was interviewed in the film and said he believed the PFLP-GC planned the attack at the behest of the Iranian government, then sub-contracted it to Libyan intelligence after October 1988, because the arrests in Germany meant the PFLP-GC was unable to complete the operation. Other supporters of this theory believed that whoever paid for the bombing arranged two parallel operations intended to ensure that at least one would succeed; or, that Jibril's cell in Germany was a red herring designed to attract the attention of the intelligence services, while the real bombers worked quietly elsewhere.
