Inquiry into Megrahi release announced

[This is the headline over a report in today's edition of The Herald. It reads in part:]

MPs will investigate the release of the man convicted of the Lockerbie bombing as part of a wider probe into relations between Westminster and Holyrood, it has been announced.

The inquiry by the Commons Scottish Affairs select committee will also study how a prisoner transfer agreement was negotiated between Libya and the UK.

The committee, chaired by Mohammad Sarwar, Labour MP for Glasgow Central, announced the move. (...)

The decision to free him on compassionate grounds was taken by Kenny MacAskill, Justice Secretary in the minority SNP administration in Edinburgh.

But Mr MacAskill turned down a separate application for Megrahi to be sent home under a prisoner transfer agreement struck between the UK and Libya.

Throughout the controversy, Westminster insisted that decisions on Megrahi were the sole responsibility of the Scottish Government.

And the Scottish Government said the decisions were made by Mr MacAskill alone, acting in a quasi-judicial capacity.

Long before the controversy over Megrahi’s release the prisoner transfer agreement prompted a row between Edinburgh and London, when First Minister Alex Salmond complained his administration was not consulted over the “deal in the desert” that led to the agreement.

The Scottish Affairs committee said its inquiry would study the arrangements in place for communication between the UK Government and the Scottish Executive when London drew up the international policy affecting Scottish interests “with specific reference to the negotiation of the prisoner transfer agreement between Libya and the UK and the case of Mr Abdelbaset Al Megrahi”.

It would study whether there were effective two-way channels of communication, and the arrangements for assessing the impact of UK foreign policy on Scottish interests and vice versa.

Peter Wishart, a member of the committee and SNP MP for Perth and North Perthshire, said: “The Foreign Secretary, the Westminster Justice Secretary, and representatives of the Scottish Government will be asked to give evidence and I am looking forward to exploring with ministers the background and basis of the PTA.

“We will quite rightly not consider the decisions made by the Scottish Justice Secretary.”

[When, oh when, will some parliamentary committee -- UK or Scottish -- have the courage to launch an inquiry into the conviction of Abdelbaset Megrahi and the concerns about it raised by the Scottish Criminal Cases Review Commission? At present all that our elected representatives seem to be willing to do in relation to Lockerbie is fritter their time away on peripheral issues. Talk about not being able to see the wood for the trees!]

    unfortunately only in German language, there too complicate in English:

    Die Politik hat sich seit 1988 bis heute mit Libyen zum Guten verändert, trotzdem leidet Libyen und der Offizielle Mr. Abdelbaset al-Megrahi, bis heute unter dem Prestige der angelasteten "Lockerbie-Täterschaft", da Mr. Megrahi durch den Rückzug seines Reappeals noch immer rechtsgültig verurteilt bleibt und indirekt auch Libyen!

    Die Wahrheit, dass Libyen und sein Offizieller Mr. Megrahi nichts mit dem PanAm 103 Attentat zu tun hatten, muss durch Vergleich der am Gericht dargelegten manipulierten Indizienbeweise (in 6 Punkten) mit den wahren materiellen Entlastungsbeweisen von MEBO AG und dem Defense Team in Schottland bezeugt werden. Dabei spielt das MST-13 Timerfragment die absolut massgebende Rolle um Libyen und Mr. Megrahi endgültig zu entlasten ...

    Da diese Möglichkeit, durch den Rückzug des Appeals zur Zeit blockiert bleibt, müssen andere Wege gefunden werden, welche die Entlastung Libyen's und Mr. Megrahi's glaubhaft bestätigt.

    Einer Eingabe durch Megrahi, 2003, für ein Reappeal wurde am 28. Juni, 2007 von der 'Scottish Criminal Case Review Commission' (SCCRC) wegen eines möglichen "Miscarriage of Justice" in 6 Punkten gutgeheissen!
    Nach Einsicht in die SCCRC Unterlagen wurde bekannt, dass ein unbekannter Staat am 13. September 1996, der "Crown UK" ein Dokument unter NATIONAL SECURITY zukommen liess, welches eröffnete, dass das MST-13 Timerfragment nicht als Zünder der Explosion infrage kommt!

    Das für Libyen und seinen Offiziellen Megrahi entlastende Dokument durfte bis heute durch den Status "Under National Security" nicht geöffnet werden, weil dies nicht im Interesse der Oeffentlichkeit sei, auf Englisch: Public Immunity Interest (PII) !

    Es folgen einige Auszüge in diesem Zusammenhang in englischer Sprache:

    At the first hearing on the 19th of October 2007 the Appeal court in Edinburgh suddenly confirmed after more than 3 months the existence of a document "under national security"; but keeps ist content closed.

    Lord Advocate Elish Angiolini QC agreed on the 20th of February 2008 to open the secret document but the UK Government by Advocate General Lord Davidson, QC, - Westminster's representative in Scottish matters - refused so and argued that it was not in the public interest to release the secret document. He claimed higher national interests: "The national security was at stake"!!!

    Prosecuting counsel Ronnie Clancy added that the secret document did not originate from the USA or one of ist agencies as the CIA.

    MEBO say: For provable special reasons only two countries come into consideration for having passed the document 'under national security' to Great Britain: Switzerland or Germany. Reason: The manipulated "Lockerbie MST-13 timer fragment" did not come from a timer supplied to Libya in 1985/86.
    'The Appeal Court in Edinburgh has decided to appoint a special defender to view confidential documents thought to contain vital information about the electronic timer that detonated the Lockerbie bomb.

    Non-disclosure of the document "under national security"

    As predicted the decision of the Lord Justice General on the 7 of March 2008 definitely not to open the document "under national security" to Megrahi’s defence will be used by the defence as a strong argument for the release of Abdelbaset Al Megrahi. The suppression of exonerating evidence for reasons of national security violates civil and human rights of the defendant and must be considered as a miscarriage of justice.

    The Lord Justice General’s decision to keep the secret document (received the 13th of September 1996) under closure indicates
    again very clearly that the whole process against Megrahi and Libya was from the very beginning a political process and not a fair criminal trial!

    Ein entscheidender Fakt wäre die Öffnung des Documents unter "National Security" (PII).

    Für mich kommen zwei Staaten für das "PII Dokument" infrage, die Schweiz oder Deutschland, welche professionelles Wissen über das MST-13 Timerfragment zu dieser Zeit 1996 hatten, in Deutschland über Fa. Siemens und BKA, für die Schweiz über die BUPO, MEBO und Ing. U. Lumpert. Hiermit möchte ich der Scotish Justiciary folgenden Vorschlag unterbreiten:
    Die Öffnung des Documents könnte für Libyen, Mr. Megrahi und alle in der Lockerbie-Affäre involvierten Personen, Security Organisationen und Staaten, nur von Vorteil sein.

    Würde sich zum Beispiel die Schweiz, insofern es zutreffen würde, sich als Lieferant bekennen, das für Libyen entlastende "Document under National Security" 1996 der "Crown UK" zugestellt zuhaben, wäre das eine einmalige Gelegenheit für die Schweiz mit Libyen den Status Quo wieder herzustellen...

    Sollte die oben genannte Hypothese Fakt sein, sollte der Schweizerische Bundesrat dem Secretary of Justic Mr. MacAskill die Genehmigung erteilen, das Dokument (PII) zu veröffentlichen, da die Schottische Justiz dieses PII-Zertifikat geschlossen hält, um die Beziehungen zu einem befreundeten Land nicht zu belasten. Immer vorausgesetzt natürlich, dass das Dokument 1996 von der Schweiz übergeben wurde.

    Wem wäre damit gedient:

    > Der Schottischen Justiz: Da das Dokument, rechtlich korrekt, durch Lord Advocate Fraser dem Gericht in Zeist 2000 vorenthalten wurde und dadurch ein "misscarriage of justice" möglich wurde!

    > Mit diesem Fakt könnte Libyen seine Nichtbeteiligung am PanAm 103 Attentat beweisen und sein Prestige gegenüber der Welt via UN aufwerten.

    > Mr Abdelbaset Al Megrahis letztem Wunsch, seine Ehre wieder herzustellen, könnte entsprochen werden, immerhin ist er zu Unrecht als 270-facher Mörder verurteilt worden.

    > Die Schweizer Bundespolizei ehemals "BUPO", welche frühzeitig 1996, vor dem Gerichtsverfahren in Kamp van Zeist 2000, United Kingdom über die MST-13 Timer Angelegenheit aufgeklärt hatte, hätte rechtlich korrekt gehandelt und politisch nichts zu befürchten!

  3. I followed up an e-mail sent yesterday to the Chairman of the Commons Scottish Affairs Select Committee, Mohammad Sarwar MP, with this morning's e-mail:

    Dear Mr Sarwar,

    Select Committee inquiry into Megrahi release

    In my e-mail yesterday, I suggested that the Select Committee would want to question former Scottish police officers John Crawford and Stuart Henderson about their failure to investigate the murder of the most prominent of the 270 victims of the 1988 Lockerbie bombing: UN Commissioner for Namibia, Bernt Carlsson.

    The Committee will doubtless also wish to quiz ex-DC Crawford and ex-DCS Henderson over the highly critical remarks they made in relation to the decision taken by Scottish Justice Secretary, Kenny MacAskill, to release Abdelbaset Ali Mohmed Al Megrahi on 20 August 2009 ( http://thescotsman.scotsman.com/latestnews/Lockerbie-detective-MacAskill-was-naive.5580431.jp ).

  4. MISSION LOCKERBIE:

    Ex-FBI Task Force Chief, Richard Marquise, wants to reiterate and correct his doubtful statements made in the documentary "Lockerbie revisited" by Gideon, with once again wrong facts !

    It is precarious that such person was assigned to occupy such a high position as an investor in the Lockerbie-case !
    Just can't believe it !

  5. Huh... Regarding the actual subject here, if they're investigating his release, which was a decision of MacAskill's, and they're not going to look at macAskill's decisions, what are they looking at here? His actual release, like which door he was taken out of, in what weather? Dumbass charges of oil deals behind the savage's release? Anything to senselessly smear each other with? Decisions and their reasoning is not on the agenda?

    To whit:

  6. Oh and Prof. Black, if you read these comments, know that I find your website, and you, totally awesome. People should stop griping about damage to the Scottish legal system becoming known, and start following your lead to heal it ASAP.
