Knox deserved to go free – just like ‘Lockerbie Bomber’

[This is the heading over a section of conservative commentator Peter Hitchens's column in today's edition of the Mail on Sunday. The section reads as follows:]

As it happens, I don’t think the Italian state ever came close to proving beyond reasonable doubt that Amanda Knox was guilty of murder.  So, in a general way, I am pleased that she has been freed.

But compare the frenzy of interest over this rather unimportant case with the strange silence over the equally dubious – but far more important – conviction of the so-called Lockerbie Bomber, the Libyan Abdelbaset Al Megrahi.

One of the key witnesses against him has since admitted to lying in court.

Another, described by a  senior judge as ‘an apple short of a picnic’, shockingly received a $2 million (£1.28 million) reward after giving evidence that many experts regard as highly dubious.

I suspect Megrahi’s release had more to do with the fear of a  final, successful appeal revealing inconvenient facts than it did with ­ British oil interests. If the US had wanted to stop him being freed, they could have. After all, they made us surrender to the IRA.

    'NTC' Chairman Abdul Jalil has premature assured Prime Minister David Cameron, that the new Libyan authorities will co-operate with the UK in the investigation of the PanAm-103 bombing.
    The police investigation into the PanAm 103 bombing are therefore open
    and the Police should follow the evidences wherever it leads them; also against their own officials in United Kingdom and officials in USA...
    This is good so, therefore now the way is open, that Libya's 'NTC' can require from the Crown Office reciprocal rights (International Legal Assistance) -- in order to look into-- and examine the content of the secret files of the Scottish Criminal Cases Reappeal Commission (SCCRC) and the Statement of police-officer, Witness (alias) "GOLFER" for clearing up the dirty "Lockerbie Affair" !

    There is evidence here that certain government personnel were warned in advance to cancel reservations on Pan Am 103. At least two warnings about a bomb on a US airliner came through the FAA.
    Here is a partial list of US and South African officials who suddenly backed out of flight 103 to New York: John McCarty, US ambassador; STEVE GREEN, assistant administrator, office of intelligence DEA;

  4. Edwin, you really should know better by now!

    South African Foreign Minister Pik Botha, Defence Minister General Magnus Malan, Director of Military Intelligence General C J Van Tonder and the other 20 members of the SA delegation were never even booked on Pan Am Flight 103 in the first place (so weren't warned off taking the flight). The whole party were booked to travel (and did travel) on Pan Am Flight 101 which departed Heathrow at 11:00am on 21 December 1988 and arrived safely at JFK in the afternoon.   6. On basis of what I have seen, no, I don't think I would convict Knox.

    But nobody should compare the case to Megrahi's.

    Against Knox there is plenty of evidence against her and her boyfriend. Among other, her DNA was detected on a knife with the victim's on the blade. Co-accused boyfriend's DNA detected on Meredith's bra clasp. Boyfriend's computer was not turned on in the period where they say they saw movies on it. Knox lied several times and implicated a proved innocent person in the crime.

    Now, the evidence is disputable, and the court found that it was not safe enough for "beyond reasonable doubt".

    Against Megrahi, discarding the testimony of 2 heavily bribed prosecution witnesses, we only have that he was a Libyan on Malta on a false passport when a plane KM180 (that may have carried a bomb) took off to Frankfurt, and that he knew Bollier.

    Did I forget anything?

    Today must be proceeded from a western planned security service conspiracy against Libya! The official Mr. Abdelbaset Al Megrahi was unmistakable selected for this dirty Action ! Fatal consequences for Mr Abdelbaset Al Megrahi, because Gauci's wrong statements and of a Phantom Bomb-Bag from Malta !
    Justice for Megrahi.
    Mr Abdelbaset have nothing to do with the Lockerbie-Tragedy.

  11. I have a question for Robert Black QC. By coincidence my name is also Robert Black (Robert Grieve Black) and have no connection except a niggling doubt about the conviction of Megrahi. My question is this:
    You are considered to be one of the key players in setting up the strange court in which Megrahi was tried and yet now, here you are claiming that the case was a sham.
    If I understand correctly it was the first Scottish case ever undertaken outside Scottish soil and the first ever serious case undertaken without a jury. The actions that were tried as criminal all took place well outside Scottish jurisdiction and likewise nearly all of the material evidence.
    The Knox case took place in Italy and was tried in Italy.
    The Megrahi trial was flawed from the outset and you are considered to be its architect. What happened to make you change your mind?

  12. There are two principal reasons why the trial took place in a Scottish court (albeit sitting in the Netherlands). (a) The UN Security Council passed a resolution saying the accused should be tried in the UK or the USA. There was never any question of the Libyans surrendering for trial in America. (b) Jurisdiction in crime normally rests with the courts of the place where the criminal act took effect. In this case that was in (and in the skies over) Lockerbie, Scotland.
