Pan Am guilty of wilful misconduct over Lockerbie

[What follows is the text of a report published on the website of The Independent on this date in 1992:]

Relatives of the Lockerbie victims last night welcomed an American jury's finding of 'wilful misconduct' by Pan Am as a major step forward in their fight for adequate compensation.

Jim Swire, the British representative of the relatives, said last night: 'It is an important victory. It opens the way for substantial compensation claims, but more than that, it means airlines will at last take security seriously because it will cost too much not to.'
After three days of deliberation the jury in Brooklyn ruled in favour of the relatives of the 270 victims of Flight 103, who sued the airline claiming the baggage handling had suffered from lax security. An unaccompanied suitcase held the bomb that exploded over Lockerbie on 21 December 1988.
The result could open the way to multi-million dollar damages claims against the Pan Am insurer, United States Aviation Insurance Group (USAIG). The airline is no longer flying. Airlines throughout the world could be forced to review their security in light of the ruling.
Another trial will be needed to assess any damages claim, and none has yet been scheduled. [RB: On 21 July 1992 the jury awarded the family of the victim damages of $9.23 million.]
Dr Swire said that money alone could never compensate for the loss of a relative, but welcomed the implications the ruling would have for airline security.
He said technology able to identify unaccompanied baggage - similar to that containing the Lockerbie bomb - already existed. But it was not being widely installed at airports because of the costs involved. He said the threat of having to settle massive compensation claims in the wake of the decision in the New York case would give airline companies and their insurers a financial incentive to introduce new security systems.
'It sickens me that these changes are spurred for financial rather than humanitarian reasons, but that's just the way it is.'
Peter Watson, British lawyer for the families, said on the BBC that the decision would force airlines to tighten security.
'It's a warning to the airline industry that if their security is as lax, poor and haphazard as Pan Am's was on this occasion, then they face fearful damages. That is the only way a court can bring this home to an airline.'
Yesterday's verdict was greeted with sighs of relief by the many relatives and friends of the victims who crowded the courtroom. The suit sought up to $500m (£277m) in damages from the airline, which would be paid by the USAIG.
Under international treaties the amount of damages is limited to $75,000 (£40,000) for each victim, but the 'wilful misconduct' verdict means that much higher damages can now be paid.
The outcome of the trial in the US also strengthens the case against Libya. The insurance company tried to persuade the jury that the bomb was put on the aircraft in London or Frankfurt because of a slip-up in a drug operation mounted by American intelligence and that there was little the airline could have done to prevent the bombing.
Lawyers for the families argued that Pan Am was criminally negligent in its security procedures at Frankfurt and elsewhere around the world, making it possible for a bomb to be put on board the flight from a connecting airline. The defence team believes, as do the Scottish police, that the bomb was placed on a flight in Malta and checked through to New York via Frankfurt and London.
Two Libyan intelligence agents have been charged in Scottish and American courts with engineering the bombing and Libya's refusal to hand them over for trial has led to sanctions being imposed by the United Nations Security Council.

    G.Levy.: Would you have a case if you wouldn't have these evidence (MST-13 timer)?

    R.Marquise.: Would we have a case. It would be a very dificult case to prove. It would be a very dificult case to prove ... I don't think we would ever had an indictment.
    And he said also: But I can tell you that now money was paid to any witness, any witness prior to the trial. No promise of money was made to any witness prior to the trial.

    G.Levy.: And was there paid any money after he trial?

    R.Marquise.: I'm not gonna answer that.
    And he said: If someone manipulated evidence, if somebody didn't invesitgate something that should have been investigated, if somebody twisted it to fit up Megrahi or Fimah or Libya, then that person will go to jail. I mean that sincerely, that person should be prosecuted for that.

    Antrag zum Entscheid an den Bundesanwalt
    Titel: Strafanzeige gegen Peter Flückiger, ehemaliger polizeilicher Sachbearbeiter der Bundespolizei im Zusammenhang mit dem Absturz der PANAM über Lockerbie.

    Um was geht es:

    Aus der Presse ist bekannt, dass ein libyscher Staatsangehöriger im Zusammenhang mit dem Attentat auf die PANAM ­Maschine im Jahre 1989 rechtskräftig verurteilt worden ist. Entscheidendes Indiz, das zur Verurteilung führte, war der Teil eines Timers des Zündmechanismus der Bombe, das der Anzeiger (Edwin Bollier) nach Libyen geliefert haben soll. Tatsächlich lieferte Bollier seinerzeit Timer dieser Art an Libyen und auch die DDR.

    Der angezeigte Flückiger, heute Mitarbeiter beim NDB, erhielt im Rahmen der Ermittlungen von einem Mitarbeiter Bolliers einen solchen Timer, den er an die amerikanischen Behörden weitergab. Das Beweisstück soll in der Folge manipuliert worden sein, damit Massnahmen gegen Libyen ergriffen werden konnten.

    Diese Behauptung Bolliers ist nicht aus der Luft gegriffen, jedenfalls liegt ein Gutachten des wissenschaftlichen Dienstes der Kantons Zürich vor, das belegt, dass der an Flückiger übergebene Timer und das als Beweisstück präsentierte Timerfragment der schottischen Behörden nicht identisch sein können.

    Damit wird die Angelegenheit politisch äusserst heikel. Der „Beobachter“ berichtete kürzlich darüber. Dazu kommt, dass in letzter Zeit in zahlreichen Zeitschriften und Zeitungen über neue Erkenntnisse im Fall Lockerbie berichtet wurde und die Rechtmässigkeit des Urteils angezweifelt wird. Wenn nun die BA gegen einen ehemaligen Mitarbeiter (die Bupo war seinerzeit organisatorisch dem Bundesanwalt unterstellt) ermittelt, das Verfahren einstellt oder eine Nichtanhandnahme verfügt, hat das Handeln der BA stets das Potential parteiisch zu sein.

    Kommt noch dazu, dass sich Bollier durch RA Bosonnet vertreten lässt. Konkret geht es nun darum, dass es nach Auffassung des Antragstellers aufgrund der politischen Brisanz und des möglichen Vorwurfs der Parteilichkeit BA klug wäre, wenn ein ao Staatsanwalt des Bundes bestellt würde, der die Anzeige neutral bearbeitet.

  3. Dossier LOCKERBIE, 2016: The instruction for use to understand the Lockerbie Affair -(not the bombing):

    The „Lockerbie Affair“ is the work of misinformation and reverse engineering that went wrong. As the case is still open in United Kingdom, the authorities will sooner or later accept the fact that the "Evidence Fraud" around the Timer and the "Toshiba" Radiorecorder is real and not fiction or just another weird conspiracy theory.

    4 steps which lead to the „Lockerbie Affair“.

    Step 1: It became uncomfortable for a „grey eminence group“ that Gaddafi successfully built a rising economy in Libya, mainly based on the rich oil reserves of the country. Libya was in the strong position to control all aspects of their oil business and fixed the conditions. The „grey eminence group“ was determined to get Gaddafi out and their target was a change of regime. The winner would then control the business under their own terms…

    Step 2: After a misterious attack on a Boeing 747 (PanAm flight 103) over Lockerbie, experts from the „security branche“ organized specific fragments from an explosive device (IED) in order to lead the responsibility for the desaster directly to the Libyan regime.

    Step 3: With a crucial fragment (PT/35) of an MST-13 timer, of which 20 were delivered by MEBO Ltd (1985) three years before the "Pan Am 103 bombing" to the Libyan military - and fragments (AG/145) of a radiorecorder brand "Toshiba" which was sold in Libya - the Libyan regime was intentionally entangled in the Lockerbie tragedy! The MST-13 timer fragment PT/35 was not descended from a timer supplied to Libya (prototype)...

    Step 4: Thanks to unprofessional manipulated evidence, Libya (now NTC of Libya) and Abdelbaset al-Megrahi, can definitely not be blamed for the „PanAm 103 bombing“. Also Mebo Ltd must be cleared from the unfair and damaging allegations.

    Thank GOD – that on June 22nd, 1989, ex-engineer Ulrich Lumpert (Mebo Ltd) did not hand over a green Thüring MST-13 circuit board (9 layers of fiberglass). Instead he gave a brown prototype circuit board with 8 layers of fiberglass to an official oft the Swiss Federal Police (BUPO).
    This will turn out to become the key for the truth!
