Every delaying tactic in the book

Justice delayed...

More than a year has passed since the Scottish Criminal Cases Review Commission referred Abdelbaset Megrahi’s case back to the Criminal Appeal Court on the basis that his conviction might have amounted to a miscarriage of justice. More than nine months have passed since the first procedural hearing in the new appeal was held. More than six months have passed since the appellant’s full written grounds of appeal were lodged with the court.

Why has no date yet been fixed for the hearing of the appeal? Why does it now seem impossible that the appeal can be heard and a judgement delivered by the twentieth anniversary of the disaster on 21 December 2008?

The answer is simple: because the Crown, in the person of the Lord Advocate, and the United Kingdom Government, in the person of the Advocate General for Scotland, have been resorting to every delaying tactic in the book (and where a particular obstructionist wheeze isn’t in the book, have been asking the court to rewrite the book to insert it). The judges on a number of occasions have expressed disquiet at the Crown’s dilatoriness; but have so far done nothing meaningful to curb it. This must end. The delay is becoming scandalous. The reputation of Scotland’s criminal justice system is being further tarnished in the eyes of the world.

And all the while a man languishes in Greenock Prison. I have never made any bones about my view that the conviction of Abdelbaset Megrahi on the evidence led at the Scottish Court in the Netherlands is the worst Scottish miscarriage of justice in the past one hundred years, indeed since the conviction of Oscar Slater. But even those who do not share my views, or who are neutral on the issue, would surely accept that the delay in bringing the new appeal to a hearing on the merits is beginning to look cruel and unconscionable.

It is up to the judges to start cracking the whip. The words of Francis Bacon in his essay “Of Judicature” are perhaps worth recalling:

“A judge ought to prepare his way to a just sentence, as God useth to prepare his way, by raising valleys and taking down hills: so when there appeareth on either side an high hand, … cunning advantages taken, combination, power, … then is the virtue of a judge seen, to make inequality equal; that he may plant his judgment as upon an even ground.”

[RB: Had the mills of the Scottish criminal justice system not ground so outrageously slowly, Abdelbaset Megrahi’s appeal could have been heard and his conviction quashed before his prostate cancer was diagnosed. The Crown Office, the UK Government and the High Court of Justiciary have much to be ashamed of over this aspect of the Lockerbie fiasco as over many others.]

    Das selbe gilt auch für die 'Schweizer Justiz' - bei der Wahrheitsfindung in der "Lockerbie Affäre".
    Seit der Strafanzeige, von MEBO Ltd & Edwin Bollier, am 10. November 2011, gegen einen Mitarbeiter (P.F.) des Schweizerischen Nachrichtendienstes (NDB) wird eine, durch das Justiz- und Polizeidepartement (EJPD), möglich gemachte Strafuntersuchungs Verfügung, in der Sache "Lockerbie Affäre" - (wegen einer unerlaubt in Besitz genommenen MST-13 Timer Platine ("Circuit Board" Prototype) und der Weitergabe an die amerikanischen Behörden) - mit allen Mitteln *Rechtsverzögert - wieso ??? - und zuletzt mit einem Urteil, durch das höchste Bundesstrafgericht in Bellinzona, abgewiesen.

    Eines wurde bereits ermittelt: Es ist eine Lüge, dass ein Gutachten des wissenschaftlichen Dienstes des Kanton Zürich vorlag, das belegt dass der an Flückiger übergebene Timer/Platine und das als Beweisstück präsentierte Timerfragment der schottischen Behörden nicht identisch sein können !

    In einem Urteil, vom 7. Juni, 2016 wurde die Strafanzeige dann als verjährt erklärt und deshalb eine Strafuntersuchung nicht anhand genommen. Dazu diente u.a. ein offizielles, vortäuschendes ("fake") Dokument des Staatschutzes, welches von Beginn an offenbar nur dazu diente, den befangenen, ausser-ordentlichen Staatsanwalt (Felix Bänziger) in das Verfahren "einzuschleusen", um die Angelegenheit unter allen Umständen zu vereiteln !
    Das zwielichtige Dokument wurde vom Genealbundesanwalt Michael Lauber, am 27. 8. 2012, unterzeichnet.
    Mit Hilfe des heuchlerischen Satzes, verfasst auf dem Dokument: - "Aufgrund der politischen Brisanz und des möglichen Vorwurfs der Parteilichkeit der Bundesanwaltschaft, wäre es klug, wenn ein Staatsanwalt des Bundes bestellt würde, der die Strafanzeige neutral bearbeitet" - wurde dann Felix Bänziger, nach der Ermächtigung zur Durchführung einer Strafuntersuchung, am 17. März 2014, eingesetzt...
    Einen Tag später, am 18. März 2014, machte der Angeklagte (P.F.) beim Verwaltungsgericht St. Gallen, gegen die Ermächtigungsverfügung Einspruch, obwohl auf der Verfügung klar erklärt wurde, dass der Entscheid endgültig sei; (Art.15 Abs. 4VG).
    Daraufhin sistierte Staatsanwalt Bänziger eine mögliche Strafuntersuchung, bis das Verwaltungsgericht nach fast 6 Monaten später, den Einspruch von (P.F.) als ungesetzlich abwies...

    Mit Urteil vom 25. Juni 2015 (vom gleichen Bundesstrafgericht in Bellinzona) musste der Staatsanwalt, Felix Bänziger (AB-BA) wegen Befangenheit zurück treten und hob die Nichtanhandnahmeverfügung vom 17. November 2014, auf. Am 17. August 2015, wurde ein neuer Verfahrensleiter, der Staatsanwalt Christian Bächle, eingesetzt. Dieser verzögerte die Angelegenheit erneut...
    In der Folge verfügte dann Bächle, nach weiteren 5 Monaten, am 18. Januar 2016, wegen Verjährung, die Nichtanhandnahme der Strafanzeige gegen den Mitarbeiter (P.F.) des Schweizerischen Nachrichtendienstes 'NDB' !
    Mit dem Urteil des Bundestrafgerichts, vom 7. Juni 2016, wurde die geforderte Verjährung von Staatsanwalt Bächle rechtskräftig.

    *Rechtsverzögerung ist eine vorgeschriebene Amtshandlung, welche nicht binnen gesetzlicher oder angemessener Frist vorgenommen wurde.

    Jetzt wird MEBO Ltd & Edwin Bollier, gegen die Gerichte u.a. wegen dem "konstruierten" Staatsschutz Dokument, welches zur vorsätzlich inszenierten Verjährung diente - und am Ende beim Europäischen Gerichtshof, sowie bei der 'Scottish Justice', weiter Klage einreichen.

Well said Robert but then when you are as guilty as hell and you have lots of bad things you want to keep hidden and don't want it to all come out in a court of law you will do everything in your power to make sure you don't get found out. "They" can't afford the truth of what they were up to over Lockerbie ever to come out and on whose behalf they were doing it.

  3. Of course, to hide criminal error by the United States in murdering innocents by the USS Vincenes 6 months before Lockerbie.
