[What follows is taken from an article published in today’s edition of The Scotsman:]
Kenny MacAskill is expected to be the most high-profile casualty when Nicola Sturgeon puts her own mark on the SNP administration by reshuffling her cabinet.
Last night, Ms Sturgeon was putting the finishing touches to the make-up of her team, amid intense speculation Mr MacAskill will lose his job as justice secretary.
Ms Sturgeon’s aides indicated the reshuffle would happen “very shortly” and there were strong signs that the announcement will be made today.
Mr MacAskill has defied numerous calls to quit during his controversial spell in charge of the justice department.
A signal that he was finally on his way out emerged at Holyrood yesterday.
Fielding questions for the first time as First Minister, Ms Sturgeon pointedly failed to defend the justice secretary when Lib Dem leader Willie Rennie suggested “everyone knew he was going”.
Ms Sturgeon responded by listing some of the Scottish Government’s justice policies, but failed to mention Mr MacAskill.
After First Minister’s Questions, Ms Sturgeon’s spokesman was asked why she had not denied Mr MacAskill faced the sack. He said: “I am not going to indulge in fevered speculation. The First Minister will confirm her line-up very shortly.” (...)

Ever since Mr MacAskill freed Lockerbie bomber Abdelbaset al-Megrahi, his time at the justice department has been dogged by controversy.
[RB: Kenny MacAskill has not been a distinguished Cabinet Secretary for Justice. His stonewalling and prevarication over the need for an independent inquiry into the Lockerbie investigation, prosecution and trial has been disgraceful. The feebleness of his excuses for refusing such an inquiry has been pitiful. The refusal to appoint an independent investigator to look into Justice for Megrahi's allegations of criminal misconduct in the Lockerbie investigation, prosecution and trial was shameful. One thing he cannot justly be criticised for, however, is his compassionate release of Megrahi (though the procedures that he chose to adopt in reaching his decisions on prisoner transfer and compassionate release are open to censure).]

Aus der Aufsichtsbehörde über die Bundesanwaltschaft (AB-BA) wurde bekannt, dass der ausserordentliche Staatsanwalt Felix Bänziger, im Aspekt des Prozesses zum Attentat auf die Boeing 747, Flug "PanAm 103", über Lockerbie, welchem im Jahr 1988 270 Menschen zum Opfer fielen, keine Strafuntersuchung einleiten will.
Felix Bänziger stellt grundsätzlich in Frage, dass die Tatbestände gehören schon gar nicht zu denjenigen, deren Verfolgung unverjährbar ist. Die angeblichen Fehler der Bundespolizei erfolgten zeitlich deutlich später (22.Juni 1989) als das Attentat vom, 21. Dezember 1988.
Mit der Planung und Durchführung des – wohl unverjährbaren – Terroraktes hatte die Bundespolizei auch nach der Darstellung des Anzeigers (Edwin Bollier & MEBO AG) nichts zu tun.
Die Verfügung des a.o. Staatsanwaltes ist noch nicht rechtskräftig. Gegen sie kann beim Bundesstrafgericht *Beschwerde geführt werden. Ende.

*Sicher werden Edwin Bollier & MEBO AG, das Bundesgericht, oder wenn nötig - nach Ausschöpfung der nationalen Gerichte - auch in diesem Fall, den Europäischen Gerichtshof (EGMR) anrufen.
Ja, die potentiellen Straftaten des bekannten und möglichen unbekannten Staatsbediensteten sind verjährt; dies war nie in Frage gestellt worden.
Es geht jedoch darum, dass verjährte illegale "Machenschaften", durch die Möglichkeit einer vom EJPD erteilte Ermächtigungsverfügung, für eine Strafuntersuchung benützt werden kann, um das Internationale gegenseitige Rechtshilfeabkommen - Schweiz/ Scotland U.K. in die Untersuchung, mit-einzubeziehen. Dies würde endlich die Handhabe bieten, das entscheidende Beweistück im 'Lockerbie-Fall' - ein MST-13 Timerfragment (PT-35) beim Forensischen Institut der Kantonspolizei Zürich, forensich u.a. auf Sprengstofspuren, prüfen zulassen.
Würde bei Prüfung, das MST-13 Timerfragment 9 Lagen Fiberglas ausweisen, zeigt es Richtung Libyen und auf das PanAm 103 Attentat. 8 Lagen Fiberglas würde darauf hinweisen, dass es sich beim (PT-35) Timerfragment um einen "Mammut-Beweisbetrug" handelt und auf die, bei MEBO AG, von einem bekannten Mitarbeiter der (ex 'BUPO', jetzt 'NDB') - illegal in Besitz genommene MST-13 Timerplatine (Prototype) - hinweist...?

ReplyDeleteDer ausserordentliche Staatsanwalt Felix Bänziger, sowie der, in Ausstand getretene Vorgänger, Staatsanwalt Peter Lehmann - wollen offensichtlich nicht mithelfen, das rechtsgültige, schottische "Fehl-Urteil" (Miscarriage of Justice) gegen den Offiziellen, Abdelbaset al Megrahi und gegen den Staat Libyen, aufzuklären. WIESO ?:
Sollte der Beweisbetrug mit dem MST-13 Timerfragment (PT-35) zu Gunsten Libyen's aufgeklärt werden, könnte "LibyaNew" bis US$ 50 Milliarden Schadenersatz einklagen; und auch für die Schweiz sehr teuer werden, sollte sich ein rechtsgültiger Zusammenhang mit der illegal in Besitz genommenen MST-13 Timerprintplatine herausstellen !
Offiziell (2007) hat die Scottish Criminal Case Reappeal Commission (SCCRC) das Urteil als ein potenzielles "Miscarriage on six grounds" bestätigt.
Nun jedermann kann sich ausdenken, wieso mit allen Mitteln versucht wird, dass mit der Einbindung der Rechtshilfe, das entscheidende Beweisstück des MST-13 Timerfragment (PT-35) als Betrug aufgedeckt werden kann. Deshalb soll 'Pandora's Box' VERWIRKT bleiben..

Attacking Kenny Mac for there being no Megrahi inquiry is totally unfair whatever else his shortcomings might be. Why are you never willing to concede that no political party IMHO is going to volunteer an inquiry.

If he had the courage to free Megrahi notwithstanding virulent US opposition -- and he did -- he could have had the courage to institute an inquiry. ReplyDeleteIt is of course sadly obvious that the willingness to accept the wrath of USA came from the fact that a deal - explicit or not - to get Megrahi to drop his appeal was necessary to save the system from an unimaginable nightmare.

Are we to accept this as being the democracy we live in? That blatant untruths - here a wrongful conviction in a case of mass murder, and a sick judicial system - is supported forever because there is 'political consensus' that 'we better not mess with it'?
