Tony Blair, the deal in the desert and terrorism

[What follows is excerpted from an article by Aneela Shahzad headlined Tony Blair’s crimes that appears today on the website of Pakistan's The Express Tribune newspaper:]

Since US Forces started their final evacuation from Afghanistan, Britain’s ex-PM Tony Blair has been more distraught than anyone. Calling the withdrawal “tragic, dangerous, unnecessary” and “in a manner that seems almost designed to parade our humiliation”, Blair reminded a retreating West that “Islamism… is a first-order security threat”, and this time the radical Islamist will be using ‘bio-terrorism’.

Mr Blair is being hailed by some as a possible replacement of Boris Johnson in the next elections, but Blair’s recent statements on Afghan withdrawal are surely more than just an election stunt, as they come from a man who has been instrumental in seeding wars around the Islamic world, like in Afghanistan, Iraq, Syria and Libya. Going back to 2004, three years after the US invasion of Afghanistan and one year after the invasion of Iraq, Blair connived with Barack Obama to intervene in Libya; and suddenly after decades of suspended diplomacy between the US/UK and Libya, it was decided that Blair would visit Libya to make the infamous ‘deal in the desert’, wherein in exchange for an oil deal with BP and cooperation on the War on Terror, the UK would return Lockerbie bomber Abdelbaset al-Megrahi to Libya and moreover all Libyan dissidents from Europe would be returned to Libya. In making this deal Blair laid the seeds of replanting UK-nurtured LIFG [RB: Libyan Islamic Fighting Group] into Libya, which would eventually become the rebel force that would topple Libyan cities on ground as Nato airpower would pound them from the skies.

This LIFG was composed of al-Qaeda members who had returned from the Afghan front after the end of the Russo-Afghan War, and had been given asylums in the UK. Meaning that Blair was the person responsible for the lodging and funding of these ‘Islamist’ ‘terrorists’ on Britain’s soil and their export into Libya!

MacAskill: I’ve never believed Megrahi to be the bomber

[An article by Kenny MacAskill in today's edition of The Scotsman is headlined Lockerbie bomber was freed ‘to protect Scotland’, says Kenny MacAskill. It reads in part:]

... as justice secretary in 2009, it was my responsibility to consider applications for prisoner transfer and compassionate release made by Abdelbaset Ali Mohmed al-Megrahi, the only man every convicted of the crime. That saw me engage with state leaders as well as with the families of the victims from around the globe, for Lockerbie was truly international in its dimensions both with those who perpetrated it and those who suffered by it.

As with the atrocity itself, that period is also ingrained in my memory. It couldn’t be anything else given the significance of it and the focus that fell upon me. I realised it was going to be big but it was impossible at the outset to realise just how big. Later, finding my face on the front page of the Wall Street Journal and other international media brought it home.

But, though I’m now part of what seems a never-ending saga, my own involvement was quite truncated, most taking place over a short space of time from spring 2009, when an application for prisoner transfer was submitted by Libya, through to August of that year when I made my decision to release on compassionate grounds.

Of course, there had been involvement before as, just weeks into my tenure in 2007, it was announced that the UK and Libya were seeking to conclude a prisoner transfer agreement (PTA). There was of course only one Libyan national detained in Scotland and it was evident that the UK’s intention was his release. Indeed, Jack Straw, the UK justice secretary, was quite open about it when I spoke to him. BP were seeking a major oil contract and without it the deal would go to an American competitor.

New Labour had either forgotten about devolution or failed to notice that an SNP administration was now in charge at Holyrood. The First Minister quickly raised objections and the UK realised that there were complications. However, though I was involved in discussions, much was dealt with by Alex Salmond given the constitutional aspect.

As debate raged on over the PTA, however, a further twist in the tale came when Megrahi was diagnosed with terminal prostate cancer. I was advised of that in September 2008 but things still seemed a long way off, as arguments over prisoner transfer continued and his illness was in its early stages. Indeed, I recall a conversation with my wife at Hogmanay that year when I explained it would be my decision but there still seemed no immediacy.

But, by spring 2009 the pace was picking up as the UK ignored Scottish objections and signed a treaty with Libya. Likewise, Megrahi’s health was worsening and it would only be a matter of time before an application for compassionate release would be submitted.

The months following were to become quite frenetic. Prisoner transfer applications have set timetables and accordingly the clock was ticking. Invariably the responsibility was compounded by us being not just a minority administration but the first ever SNP one. If there were to be political casualties then they would be limited to one. The decision would be for me alone.

However, I was remarkably well supported by staff, even more so as the days passed and pressure mounted. There was no consensus that could be brokered or solution that would see it all just go away. Accordingly, I resolved that the decision I had to make wouldn’t be subject to economic or strategic issues but based on the laws and guidance that applied. They would be followed scrupulously and wherever possible information and actions would be open and public.

That remained the policy of the Scottish Government throughout.

The only red line I ever set was that Megrahi wouldn’t die in a Scottish prison cell. Rejection of either or both applications remained open until my final conclusions but it simply meant that he’d never be allowed to pass away here, even if it meant being medically evacuated at the very last moment. I wasn’t prepared to risk the lives of those who worked in health or prisons through the creation of a martyr and attacks following from those who perpetrate such terror. Events in cities around the globe since then have simply confirmed my view.

But increased security soon surrounded me as governments and organisations from far and wide sought to make their views known. Locked car doors and being driven everywhere were immediately noticeable, though to the chagrin of my driver I often insisted on walking. Hourly drive-bys by police vehicles at home and my office, and even panic alarms installed at both. Sadly, that level of intrusion also impacted on others as my wife from whom I’d recently separated also required to endure it.

It did, though, create a bond with those who worked with me and shared the risks that I’ll take to the grave.

My staff did their best to insulate me from undue pressure and I recall being advised that Robert Mueller, currently investigating President Trump but then FBI director, had sought to have a letter delivered personally to me. It was out of office hours and contrary to diplomatic protocols and his request was speedily rejected by my office, who advised it could be delivered to St Andrews House in the usual manner. I remained sound asleep oblivious to it all but was told that a police armed response team had been scrambled to my address just in case, greatly endearing me to them ever since.

To make a decision, evidence had to be heard from victims’ families and States. Much was harrowing indeed with many meetings being distressing for staff and myself. Governments varied in their attitudes. The Libyans convivial but with an underlying hint of menace; the Americans business like but co-operative with information; whilst the UK was shameless, all the time conniving for Megrahi’s release but equally insisting it was nothing to do with them.

Many politicians were equally shameful. Labour in Scotland simply opposed whatever I did despite the risks to the nation and the collusion of their London colleagues with Libya. Tories likewise condemned whilst former Tory ministers sought to lobby on behalf of Anglo-Arab business interests.

As is now well known I refused the prisoner transfer request as it was clear that there had been a UN brokered agreement between UK/USA and Libya that sentences would be served in Scotland.

The legal criteria for compassionate release were also met and so I rejected the former but granted the latter.

It’s a decision I stand by to this day and whilst some disagree, with it few can fault the procedure. Indeed, information that has since come to light since has simply confirmed my view. I always knew that Scotland was but a small cog in a much bigger international wheel. The British and Americans, whatever their public utterances, were colluding with Gadhafi on everything from training his special forces to rendering prisoners to him. Tony Blair’s embrace of the Libyan despot was matched by the fawning over his family by Hillary Clinton and the desire of the west for trade deals and strategic alliances

At the same time the supposed hero’s welcome received by Megrahi on his return to Libya was shown to have been fake news which the British and Americans were aware of. But they were never going to allow truth to stand in the way of an opportunity to heap opprobrium on Scotland. (...)

Questions remain over the conviction of Megrahi but whilst I’ve never believed him to be the bomber, he most certainly was no innocent abroad. He was the highest-ranking official Libya would release and the lowest one the west would accept. [RB: There is absolutely no evidence that I am aware of that the west sought higher-ranking officials than Megrahi and that Libya refused; and, given my contacts with the Libyan government during my efforts to secure a Lockerbie trial, I am sure I would have been informed.]

But the UK and USA know the full story, even if a court never will, having their spies and even getting their sources out. Sadly, that’s why the conspiracy theories will run for ever with me now part of them.

Reflecting on Lockerbie

[This is the headline over an article by Kenny MacAskill published yesterday on the website of Cable magazine. It takes much the same line as his recent book and merits a similar response, such as those accorded to the book in reviews by James Robertson and John Ashton. Mr MacAskill's article reads in part:]

... this month brings the sixteenth anniversary of the conviction of Abel Basset Al Megrahi at a Scottish court convened at Camp Zeist in the Netherlands. He remains the only man convicted of the crime. Megrahi was released by me in 2009, on compassionate grounds, when I was Justice Secretary. In many ways, the trial has overshadowed both the events leading up to it, and actions subsequent to it. For some, it has become a cause célèbre and for others, simply the culmination of the tragedy.
Yet, the Lockerbie bombing is not just the story of one man and his journey through the courts. It is also one of international intrigue and diplomatic duplicity.  The atrocity didn’t happen in isolation – in many ways, it was the culmination of years of terror and counter-terror. The trial and subsequent appeals only formed part of a far wider picture, one in which vested state interests were being pursued, and in which economic goals mattered more than justice. (...)
For many, especially in Scotland, the Megrahi trial itself has come to overshadow the events that led up to both the atrocity and its consequences. Perceived or real failings amongst police, prosecutors, judges, or even myself, have often distorted scrutiny of the wider issues at play. The focus, even in the media, has been on the court case rather than on the economic and security deals being traded for prisoners, or on the nature of strategic alliances, of which there were many.
Reporting of the fact that evidence was denied to the Scottish court, and threats to close down Scottish press coverage of this issue, has been muted to say the least. I know this from discussions with an Editor threatened, and with the UK Minister doing the threatening. Even false news (a popular term at this point in time) has been allowed to become received wisdom, such as the so called ‘hero’s reception’ for Megrahi after his release and return to Tripoli (despite being exposed as fake by both WikiLeaks and former State Department officials).
Perhaps there should have been more wariness all those years ago, when an Italian air force plane in UN markings collected Megrahi and his co-accused – Al Amin Khalifah Fhimah – from Tripoli, to take them to the Netherlands for trial. For though this was to be a trial held under Scots law (albeit convened in a former Dutch air force base), the major ground rules had already been set. However, the Scottish judges presiding over the trials has not yet been notified of those rules.
Vested financial interests should perhaps also have been discerned. The first Scots lawyers to visit Gadhafi travelled on a plane provided by Babcock and Wilcox. Others later returned on the private jet of Tiny Rowland.
For the trial had been brokered by Britain and the United States, in negotiation with Libya, with the intervention of many other actors (the United Nations in particular) at the very highest levels. Sanctions were hurting Libya; it needed to negotiate. The West, for its part, wanted a strategic partner in the campaign against Islamic terror, as well as access to Libya’s natural resources. The trial came about just as major companies were lobbying for access to Libya. American companies in particular were concerned at European businesses – such as BP – gaining a foothold in the North African country while they were still excluded. Marathon Oil, among others, lobbied the White House relentlessly.
The negotiations eventually resulted in the Libyans choosing Scots law for the process, albeit in a neutral venue. Scots law would always be preferable to a trial in America where little justice could be expected, and where anyone convicted was unlikely ever to see the light of day again. Handing citizens over to the United States was as unacceptable to the Gadhafi regime as it remains to every Libyan grouping to this day.
The discussions also covered the question of who would appear for trial. Megrahi and Fhimah were offered up. Others, far more culpable and senior, were also sought by the police and prosecutors. But the deal brokered by the UN exculpated Gadhafi and his leading henchmen – like Abdullah Senussi, Gadhafi’s head of military intelligence – from facing justice. The Libyan leadership was thus given a get-out-of-jail card. Others were not so lucky.
Megrahi and his co-accused were the highest-ranking officials that the Libyans were prepared to sacrifice – and the lowest-ranking that the West would accept. Western interests dictated that it was acceptable to live with the Libyan leadership being absolved; but someone had to stand trial. The legal process provided cover for the political and economic deals the West wanted and so Megrahi and Fhimah were offered up in the Libyan national interest.
Advice from Scottish lawyers to the accused not to present themselves for trial was ignored: new Libyan lawyers provided by the Gadhafi regime made it clear that these men would be going to the Netherlands, no matter what. Libya, crippled by Western sanctions, required these two to take the fall for the country – and they were lightning conductors, drawing attention away from anyone higher up.
And so it was that one man – Megrahi – was convicted and the other acquitted, sixteen years ago this month. The trial process was highly unusual, not just in its setting but in its format, with three judges sitting without a jury.
There are certainly questions over the reliability of Megrahi’s conviction in light of evidence that has since come to light. That’s quite understandable given the circumstances of the attack, and the scale of the crime scene. Indeed, it was a quite remarkable police investigation and great credit should be given to those involved. That said, the post-trial evidence which has emerged doesn’t mean that Megrahi was uninvolved in the crime. A mere innocent abroad, he certainly was not. He was a senior Libyan agent, from Gadhafi’s tribe, married into senior families who had faithfully carried out the regime’s instructions, both before and after Lockerbie.
This will doubtless be the focus of yet more debate. That is understandable. (...)
People will continue to form their own judgements on my decision to release Megrahi on compassionate grounds. That’s their right and entitlement. But I stand by my position. Further information received since has only reinforced my view. (...)
Before that happened, however – and this is an issue which receives far less attention – I had the opportunity to transfer Megrahi. I chose to reject this opportunity. Prisoner transfer applications are routine and were invariably granted by me, as by both my predecessor and successor. The process applies to bringing Scots who have committed crimes abroad home, as well repatriating foreign offenders from our land.
What was unusual about this particular Prisoner Transfer Agreement (PTA) was how it came about – and why I refused it. Indeed, it was the only one I ever rejected. As Jack Straw (then UK Home Secretary) told me, the UK-Libya PTA came about as the UK government sought to support BP’s interest in obtaining a lucrative contract in Libya. The imperative was simple – no transfer deal, no contract – and the UK was anxious that its own company benefit from the substantial profits to be made, and not an American competitor.
I rejected the transfer application for Megrahi. I did so not because it was the only one in existence that allowed for the state and not just the prisoner to apply; nor because there was only one Libyan prisoner in a Scottish jail – the man convicted of the Lockerbie bombing. I did so instead because it became clear that undertakings had been given at the time of the trial that any sentence given to Megrahi should be served in a Scottish prison.
This information came to me not from the UK government – which was focused only on driving through the Prisoner Transfer Agreement – but from Eric Holder, the United States Attorney General. At the time the trial was being agreed, he had been the Deputy Attorney General. He was therefore a man well-placed to know what had been agreed. Holder was adamant that any sentence meted out to Megrahi should be served in a Scottish jail, even if David Miliband, the UK Foreign Secretary at the time of my decision, was unforthcoming on the issue. That is why I ruled out a prisoner transfer application which I would normally have authorised. (...)
I’m used to people taking opposing positions on my decisions; that goes with the job. I do, however, object strenuously to the disparagement of those who served the Scottish justice system at this time. No system is foolproof and that’s why safeguards are built in. All systems can make errors and need to be able to accept and atone for them. But the constant focus on just one aspect of the Lockerbie tragedy ignores the much wider picture, and lets the British and American governments off the hook for their hypocrisy and duplicitous actions.
I believe those who were involved in the Scottish justice system, at all levels in this case, deserve praise and respect. Most especially, this should go to those who attended the horrific crash scene and dealt with it as best they could. They shouldn’t be defamed for alleged planting of evidence. The work was hard and horrifying – and all at a time before PTSD was properly acknowledged, never mind treated. A dogged and determined investigation should be appreciated for the fine skills the investigators deployed – not denigrated for alleged falsities. Then, at the trial stage, both prosecutors and judges acted professionally in dealing with the facts then before them.
There are good people who have genuine doubts about the integrity of the trial, such as Dr Jim Swire, who lost his daughter in the tragedy. Though I respect them, I profoundly disagree with them. Meanwhile, there are others who are part of a ‘Megrahi industry’ that has been in business since the corporate jets were first utilised. Conspiracy theories abound and most, as is usually the case, are simply nonsensical.
Meanwhile, it shouldn’t be forgotten that not just the American victims’ families but most others stand by the conviction, even if almost all recognise that there’s more still to come out. Much has, of course, been leaking out in dribs and drabs as further information about British and American links with Libya emerge, and as the CIA extract more people in the know from the failed Libyan state they’ve created. I’ve always supported the Scottish government’s position on the benefits of having an international enquiry to consider all aspects of the Lockerbie affair. A Scottish court alone has no powers to compel the necessary witnesses, or obtain the required information.
Yet while there are legitimate questions over the strength of the conviction, which I share, this bombing was carried out by Libya. The evidence shows it, Gadhafi admitted it, and the National Transitional Council which replaced him also accepted that his regime was culpable.
The Lockerbie bombing was the horrific culmination of years of terror and counter-terror. From atrocities at Rome and Vienna airports and bombings in Berlin bars, to sanctions on Libya and even air strikes on Gadhafi’s family compound in 1986. It culminated in the downing of an Iranian airliner by the USS Vincennes in July 1988, killing all aboard. President Bush refused to apologise for this act and it caused outrage across the Arab world. A bounty was put up to avenge the act and that was accepted by the Popular Front for the Liberation of Palestine General Command (PFLP-GC).
This group was planning the downing of a Pan Am airliner, resulting in the Helsinki warning in the form of a memorandum issued by the US State Department to American embassies. This has fuelled conspiracy theories ever since. In fact, all it showed is what we’ve come to experience in recent years: that security services know something is planned, but don’t necessarily know when or where, and security is tightened accordingly.
However, the detention of a PFLP-GC cell in Germany some two months before the Lockerbie bombing spiked the initial bombing plan. Those arrested had Pan Am timetables and bag tags, and were planning an operation in a similar style to what ultimately befell Flight 103. Thwarted this time, what was to be done to fulfil the contract?
The PFLP-GC operated closely with the Libyans – also with Syria, Iran, and other Middle East states. In the PFLP-GC’s time of need, the Libyans stepped into the breach to help them in their next, decisive, plan. Tripoli had been aware of what had been going on, as Gadhafi himself would later admit. Though, as he added, had they planned it, they wouldn’t have used Malta as it was too geographically close to Libya and would have raised suspicion. But, presumably needs must and so Libya finished off the terror strike initially planned by the Palestinians. There are serious questions as to just how the fateful bomb was placed aboard the Pan Am aircraft in Malta: it remains a mystery to this day. But Gadhafi confirmed that it was planted there.
Megrahi and Fhimah weren’t the principal parties involved, although – as noted earlier – suggestions of their complete innocence are fanciful. Those who would sanctify Megrahi forget he was a senior security service agent in a despicable regime. The idea that he just found himself in Malta on a false passport, with no apparent luggage as some innocent abroad, is absurd. I certainly doubt that he was the bomber, but given who he was and the roles he held, I have no doubt that he was involved in the wider operation. (...)
So as the anniversary comes round, people will form their own views and make their own judgements – on me, and on Scottish justice. But let them also examine the economic and strategic backdrop which saw sanctions dropped and prisoners rendered in return for access to natural resources and a strategic ally against Islamic terrorism. The process of justice around the Lockerbie bombing offered up two minnows but protected the major players – a situation which continues to this day. It was a process which also saw Britain and America condemn the release of Megrahi while openly consorting with Gadhafi.
The court case, like Scotland more broadly, was just one small cog in a far larger wheel.

BP executive "helped to release Megrahi"

[What follows is excerpted from the obituary of Sir Richard Paniguian published in The Times today:]

BP executive who worked with the Intelligence services and helped to release the ‘Lockerbie bomber’

As an oil industry executive turned spy, Sir Richard Paniguian helped to negotiate the release of Abdelbaset al-Megrahi, the former head of security for Libyan Arab Airlines, who had been convicted in 2001 of organising the bombing of the Pan Am plane that exploded over Lockerbie in 1988, killing 270 people.

Megrahi was released in 2009 after widespread criticism of his conviction. While the British government denied any involvement in Megrahi’s release, confidential documents suggest that it was prompted by pressure from the Libyan leader, Muammar Gaddafi, in return for BP oil contracts and counterterrorism assistance.

BP admitted pushing for a prisoner transfer deal. The month after Megrahi returned home, Paniguian gave a speech in which he said that “high-level political interventions” had enhanced the prospect of arms sales to Libya.

Sir Richard Paniguian, CBE, oil industry executive and security chief, was born on July 28, 1949. He died of a heart attack on June 25, 2017 aged 67

[RB: I confess that this is the first time I have encountered this particular name in connection with Lockerbie. It is perhaps worth emphasising that it is the British Government, not the Scottish Government, that is referred to.]

No economic or commercial motives for Megrahi release decision

[What follows is the text of a press release issued by the Scottish Government on this date in 2010.]

First Minister Alex Salmond has today replied to the letter from Senator Menendez of July 29.

This follows the First Minister's previous letter to Senator Menendez on July 26, which answered five detailed questions from the Senate Foreign Relations Committee and also provided copies of documents.

The First Minister has also previously written to Senator John Kerry on July 21, providing comprehensive information and assistance ahead of the planned hearing which was later postponed. Senator Kerry described this correspondence as "thoughtful and thorough".

The letter is copied below:

Dear Senator Menendez

Thank you for your letter of 29 July.

I have made clear in my letters to you and to Senator Kerry that the Scottish Government's decision to decline your previous invitation for the Cabinet Secretary for Justice and Dr Fraser to attend a hearing in the US was based on principle rather than on any issue of practicality.

The most appropriate way for us to assist the Foreign Relations Committee is to provide a statement of the position of the Scottish Government, as I have done, and to answer any questions that the Committee may have in writing, as we have also done.

Scottish Ministers and public officials are properly accountable to the Scottish Parliament and not to other legislatures. It is difficult to envisage circumstances in which serving members of the US Government would agree to appear as witnesses in hearings or inquiries held by the legislature of another country, and there are many high-profile and indeed current examples of the US Government declining such invitations.

Your letter again seeks to link BP with the decision made by the Scottish Government to grant Mr Al-Megrahi compassionate release. No-one has produced any evidence of such a link because there is none. We have said repeatedly that there has never, at any point, been any contact between BP and the Scottish Government in relation to Al-Megrahi. The statements we have made on this issue are entirely clear and consistent.

It was with concern that I watched you attempt to insinuate such a link on BBC Newsnight on 30th July by citing a letter from Conservative Party peer Lord Trefgarne, the chair of the Libyan British Business Council, to Justice Secretary MacAskill last year. This was one of approximately one thousand representations received by the Scottish Government last year, including many from the USA. You have this letter because the Scottish Government published this last year as part of our comprehensive issue of documentation related to the decision. That being the case, you must also have seen the reply from Mr MacAskill, also published, which stated that his decisions would be "based on judicial grounds alone and economic and political considerations have no part in the process". In order to avoid any suggestion of misrepresentation, I trust that you will include that fact in future references.

BP's admitted lobbying on this issue referred to the Prisoner Transfer Agreement (PTA) and with the UK Government. As you must by now be aware, the Scottish Government opposed this agreement from its inception, a position that we have maintained publicly and privately since. Indeed, I revealed the existence of the proposed PTA to the Scottish Parliament in a statement on 7 June 2007. It is perhaps to be regretted that our warnings about the circumstances in which this agreement came into being found no response at that time from the UK Government, the then opposition in the UK Parliament, or indeed from the United States Senate.

Finally, you and some of your Senatorial colleagues, have suggested that the Scottish Government have sought to pass responsibility to others for the release of Al-Megrahi. That is simply not the case. Secretary MacAskill took the decision following the precepts and due process of Scots law and jurisdiction - the same jurisdiction which over a period of some 20 years led Scotland to play the leading role in investigating, trying, convicting and incarcerating Al-Megrahi. We do not resile from our responsibility in making that decision.

The point we make is a different but a quite simple one. Please do not ascribe to the Scottish Government economic or commercial motives for this decision when there is no evidence whatsoever for such a claim.

If you wish to investigate commercial or indeed other motivations surrounding this case, then call the former UK Ministers and Prime Ministers who were involved in proposing, negotiating and then signing the PTA and, of course, where there is a public record of admission that business and trade, along with other issues, were factors. In this light your decision not to proceed with the draft invitation to offer evidence to former Prime Minister Blair, who actually signed the proposed PTA in May 2007, seems puzzling.

These people, of course, may have had, and indeed in some cases have conceded, motivations other than justice considerations. However, they did not take the decision on Mr Megrahi.

Not the finest hour

What follows is an item originally posted on this blog on this date in 2010. The comments following the post are also well worth reading.

An independent judicial review into the Lockerbie bombing is now essential


[This is the heading over a letter in today's edition of The Herald from Iain A D Mann. It reads as follows:]

It is becoming clearer by the day that an independent judicial inquiry is now essential into all the events surrounding the PanAm 103 disaster and the subsequent conviction of one person, the Libyan Abdelbaset Ali Mohmed al Megrahi, for the crime ...

The pathetic attempt by some US Senators to investigate this deeply complex matter in one afternoon session, by grilling a few foreign politicians on the basis of misguided assumptions and misunderstood facts, underlines how important it now is to have such an inquiry in the United Kingdom (or Scotland) under proper judicial conditions.

If a public inquiry continues to be refused by those in authority, the alternative is to find some way to re-open Megrahi’s second appeal in the Scottish courts. I cannot believe that the Scottish Government and/or the Scottish Justice Department could not devise some way of achieving this if they really wanted to. It pains me to say so, but I believe that the original trial in Camp Zeist, before three High Court judges with no jury, was not the finest hour of our much-vaunted legal system. Its reputation would be repaired, and perhaps enhanced, if it were now seen to provide an opportunity for all the relevant and previously unheard evidence to be reconsidered and tested in court.

Whether that scrutiny is by a public inquiry or a court appeal process, it is imperative that this time both the UK and US governments make available all the relevant documents that they have so far disgracefully refused to disclose, on the spurious grounds of either “national security” or “not in the public interest”. The Scottish Criminal Cases Review Commission, after an exhaustive three-year investigation, reported no fewer than six possible reasons for a possible miscarriage of justice, and these must be properly examined and tested judicially.

I am sure there are many like me who want to prove to the world that our country – Britain and Scotland – is still a true democracy, where justice is not denied or distorted by those in authority for whatever misguided reason. The families of all the 270 victims of the PanAm atrocity deserve to know the whole truth and nothing but the truth.

[A letter from Tam Dalyell in today's edition of The Scotsman reads:]

... Alex Salmond and his justice secretary should travel to Washington to blurt out the unpalatable truth; namely that their decision to release Mr Megrahi had nothing whatsoever to do with BP, compassion or legal precedent.

It had everything to do with avoiding an appeal which would have revealed the delaying and disgraceful behaviour of the Crown Office over 21 years, the "inexplicable" (the UN observer's word) decision by the judges at Zeist and the shortcomings in Mr Megrahi's original defence, not to mention the involvement of the American government in scapegoating Libya, for the crime that was carried out by Jibril, Abu Talb and the PFLP-GC.

The Americans should now be told that the motive for Mr Megrahi's release was the avoidance of the humiliation of Scottish justice in the eyes of the world.

UK Government "learned significant lessons" after deal in the desert row

[What follows is the text of a Press Association news agency report published on this date in 2010 on the website of The Independent under the headline Coalition to improve Holyrood relations after Lockerbie row:]

The UK Government said today that "significant lessons" have been learned in relations with Scotland after the row over the Lockerbie bomber's release.
The Tory-Lib Dem coalition said it wants to build more "positive relations" with Edinburgh after the fallout from the freeing of Abdelbaset al-Megrahi on compassionate grounds.
The comments came in a response to a recent Scottish Affairs Select Committee report into relations between the two administrations.
"We believe that there are significant lessons from this disagreement that have already been learnt," the UK Government response said.
"The Government's priority is to build more positive relations with the Scottish Government in all areas."
The SNP Government clashed with the previous Labour administration at Westminster over a controversial "deal in the desert" agreed with Libya three years ago without Edinburgh's knowledge.
The Memorandum of Understanding paved the way for a prisoner transfer agreement (PTA), which Megrahi unsuccessfully applied for to Scottish ministers.
Today's response states: "In future the Government will consider carefully the appropriate balance between interests of confidentiality and the responsibility to keep the Scottish Government informed of international agreements made on its behalf.
"This includes consultation with the devolved administrations on matters relating to international relations which touch upon devolved matters."
Megrahi is the only person convicted of the 1988 bombing in which 270 people were killed. He was released on compassionate grounds last July after medical evidence indicated he only had three months live.
Calls for the decision to release Megrahi to be re-examined grew in volume in the wake of the Gulf of Mexico oil spill and revelations that BP had lobbied for the PTA, amid concern that ditching it could damage an exploration deal it had signed in Libya.
Foreign Secretary William Hague described Megrahi's release as "wrong and misguided" at the weekend.
The coalition Government also remains committed to maintaining the Scottish Secretary, despite the Lib Dems, who occupy the role through Berwickshire, Roxburgh and Selkirk MP Michael Moore, having previously campaigned for it to be scrapped.
Today's response said: "The Secretary of State for Scotland will play a full and active role in policy formulation, ensuring that the devolution settlement in Scotland is fully respected during policy development, and also ensuring that the UK Government is represented in Scotland."

“Libya has always viewed him as a political hostage”

Libya's relations with Britain have been flourishing across the board since the controversy over the release of the Lockerbie bomber, one of Muammar Gaddafi's senior ministers said today.

Libya was "delighted" at Abdelbaset al-Megrahi's return home from a Scottish prison last August and still insists he is innocent of the murder of 270 people on Pan Am 103, said Abdel-Fatah Yunis al-Obeidi, the Libyan secretary general for public security.

Obeidi, whose rank is that of a cabinet minister, hinted that David Cameron's comment that Megrahi's release had been a "mistake" — fuelling the domestic and international row about the circumstances of the decision — was made under US pressure. In an exclusive interview on a visit to London, Obeidi said he was certain the former intelligence agent was innocent.

"Libya is delighted by his return and has always viewed him as a political hostage and never acknowledged him as a prisoner," he said. "Libya had no connection with the Lockerbie affair. The international community was led to believe that Libya was behind the incident but history will prove the truth. I am convinced that Megrahi was innocent and was a victim of a huge international conspiracy."

Libya agreed to pay billions of dollars in compensation to families of the victims because of demands from the UN, not because it admitted guilt over the worst act of terrorism in British history. It portrays Megrahi's release as a purely humanitarian issue involving a man suffering from terminal prostate cancer who supposedly had just weeks left to live.

"Megrahi is in the hands of God," said Obeidi. "He was in a Scottish prison. Those who made the three-month prognosis were British doctors. The fact that he is still alive is divine will and has nothing to do with Libya. If you have a direct line to Heaven you can check up there."

Renewed US interest in the affair is linked to the BP Deepwater Horizon oil spill and anger among families of the 189 US victims of the Pan Am bombing.

"The British government should disregard the views of others," Obeidi said. "We and you know who those others are. They are those who do not want Britain to look after its own economic interests and wants it to be subjugated to them for ever."

Obeidi's busy UK schedule underlines the warmth and intensity of bilateral relations since Tony Blair met Gaddafi in 2004. (...)

"Relations are excellent and getting better every day," he said. "The problem before was the absence of trust. Now we have restored confidence and there is much greater cooperation."

Libyan officials do not normally relish discussing Lockerbie, wishing to draw a line under it after the payment of compensation, the restoration of diplomatic relations with the US and UK and a wider sense that the country has shed its pariah status as western companies, backed by their governments, queue up to do business. But Libya lobbied hard for Megrahi's release — finding a willing partner in the Labour government — and the only man convicted of the 1988 atrocity was escorted home personally by Saif al-Islam al-Gaddafi, the leader's son and presumed heir. During a recent lecture in London the younger Gaddafi responded monosyllabically to a question about Megrahi, focusing instead on the "new" Libya and opportunities it presented.

Libya does not expect any adverse effect on its booming relations with the UK. "The Libyans won't really care," predicted Oliver Miles, a former British ambassador to Tripoli. "It's yesterday's problem. The worry now is Megrahi's state of health. There's no question of him being sent back to Scotland or of Libya having to pay any price. They will see it as Cameron being in the pocket of the Americans."

Salmond: Ask Blair about Megrahi


Alex Salmond told US senators they should direct questions about a prisoner transfer agreement for the man convicted of the Lockerbie bombing at former prime minister Tony Blair.

The First Minister has also accused a Tory MP of calling for Abdelbaset Ali Mohmed al Megrahi to be used as a foreign policy bargaining chip. His comments followed a weekend of renewed questions in the US and London about the decision to return Megrahi to Libya. Salmond said a Senate hearing should call the former prime minister to give evidence about the “deal in the desert” which paved the way for BP to invest £450 million in exploring Libya’s oil reserves.

Almost a year after Megrahi, who is suffering from prostate cancer, was freed on compassionate grounds by Justice Secretary Kenny MacAskill, a group of Democratic senators is demanding an inquiry into claims the oil giant lobbied for his release to smooth a deal. An influential Senate committee is also to examine the case.

A spokesman for Salmond said: “If the US Senate wants to get the truth about the deal in the desert by the UK and Libyan governments in 2007, they should call Tony Blair to give evidence. Blair was its architect – he would be the one who knows about an oil deal.”

Salmond’s spokesman dismissed a call for a UK Government inquiry by Tory MP Daniel Kawczynski, chairman of Westminster’s all-party group on Libya. He has written to David Cameron asking how the Scottish Government can be held to account and asking for more information on UK Government involvement.

Salmond’s spokesman said: “As far as Daniel Kawczynski is concerned, he wrote to the Justice Secretary in August last year saying that al-Megrahi should be used as a foreign policy bargaining chip, which is as extraordinary as it is inappropriate in relation to determining applications for prisoner transfer or compassionate release.”

The issue threatens to overshadow David Cameron’s first visit to Washington as Prime Minister tomorrow.

In a letter to US Secretary of State Hillary Clinton, Foreign Secretary William Hague said: “There is no evidence that corroborates in any way the allegations of BP involvement in the Scottish Executive’s decision to release Megrahi.”

But Hague also said that the release was “a mistake”.

MacAskill said he would “support a wider UK public inquiry or United Nations investigation capable of examining all of the issues related to the Lockerbie atrocity, which go well beyond Scotland’s jurisdiction”.

The prosecution’s case was farcical

The Lockerbie bomber? A likely story . . .

In all the furore over Abdelbaset Ali al-Megrahi, we have lost sight of one important fact.

So, the British ambassador to the US says that the government "deeply regrets" the release of Abdelbaset Ali al-Megrahi, the man convicted of the Lockerbie atrocity. Meanwhile, US senators are calling for an inquiry into allegations that BP lobbied the British government to let Megrahi go in order to protect their interests in Libya.

News of his release on compassionate grounds a year ago prompted a similar wave of indignation. The papers bleated about Megrahi showing no compassion to his victims, that this was not "justice", and that the government was ignoring the victims of the bombing. (...)

What is rarely mentioned amid all the outrage is that there is considerable doubt over Megrahi's guilt.

As the late Paul Foot pointed out, having sat through the whole of Megrahi's trial at [Zeist] in 2001, the prosecution's case was farcical.

That Megrahi felt the need to write 300 pages about his innocence is odd -- one ought to have sufficed.

To summarise, Megrahi is meant to have planted a bomb on a plane in Malta, which then travelled on to Frankfurt, and then on again to Heathrow, before finally exploding on Pan Am Flight 103 in the sky above Lockerbie. We are supposed to believe, then, that the bomb got on to three planes in a row without being detected. It seems a lot more likely that the bomb was planted at London than anywhere else.

In their judgment, the three judges at the [Zeist] trial also pointed out that there was nothing that proved Megrahi had put a bomb on the plane in Malta. They noted: "The absence of any explanation of the method by which the primary suitcase might have been placed on board KM180 [Air Malta] is a major difficulty for the Crown case."

What's more, Megrahi was apparently aided by a conspirator, yet his co-accused at the Hague trial was unanimously acquitted.

The prosecution's star witness was Tony Gauci, a Maltese shopkeeper, who claimed to remember Megrahi buying clothes from his shop. These clothes apparently found their way into the case in which the bomb was concealed.

Gauci also said, however, that he remembered it raining on the day Megrahi came in, yet meteorological records show this was not the case. This does not discount Gauci's testimony, but it must give pause for thought.

His claim to be able to remember and identify a single customer many months after he apparently entered his shop is much more difficult to sustain. Again, the court expressed its reservations, saying that "Mr Gauci's initial description to DCI Bell would not in a number of respects fit the first accused" (Megrahi).

Perhaps those calling for an inquiry into the circumstances of this man's release should dig a little deeper into how he was convicted in the first place.
