While Westminster stated that there was no binding agreement with the US relatives that Megrahi should serve his entire sentence in Scotland, Kenny MacAskill was of the opinion that such an agreement did exist. That was his explicit reason for refusing the request for Prisoner Transfer - that it would betray the undertaking given to the relatives. This was despite the Westminster government being in favour of the PT.<br /><br />However, the Scottish government's position was that the undertaking to the relatives did not apply to compassionate release, because a prisoner granted release on these terms was no longer "serving his sentence". Call it sophistry if you like, but that was their official and legal position.<br /><br />This was confirmed by communications with US government in 2009 - the response was that while the US remained opposed to Megrahi being released under any terms, they would much prefer compassionate release to prisoner transfer.<br /><br />And that's what happened.
